The charges that are reflected in the contract that was signed and executed on 7/1/for [redacted] is attached to this postingIt indicates that the charges are minimum charges to turn the unit at move outIt also indicates the turn costs are the residents responsibility and will be prorated with the length of the stayThe lease was year exactly indicating the resident is responsible for 100% of the turn costWith that said we charged $for the carpet clean, which we are charged $This was an oversight on behalf of our community and will be adjusted accordingly to the new dispo, creating the credit of $The clean was a charge of $which was invoiced for $The paint charge was $and we charged on the dispo $With that said we are $out of pocket due to error in charging your accountWe also did not receive final payment upon move out for final utilities in the amount of $for the last days creating an outstanding balance of $at move outAll charges were associated with the lease that was signed by [redacted] and ***The total refund will be reflected in a new dispo we have emailed giving a refund of $instead of the original $

Complaint: [redacted] I am rejecting this response because:The lease states no where that there is a minimum or maximum fee for either carpet cleaning or painting as can be seen in the attachment they included in their last reply - I believe they are referencing the section below in the lease which is talking about general cleaning feesAdditionally, photos taken upon moshow that there was wall and paint damage prior to me moving in (see attached photos) Because of this, charging me for painting when the lease states that the premises will be returned in the original mocondition is contradictiveIt is clear from the photos that my apartment was not painted prior to my move inAs stated by an employee of Heritage Park during one of our many conversations, it would be "unethical" to charge me for painting considering the condition of my apartment upon move-inLastly, Heritage Park is still unable to provide me with a detailed, itemized list of what needed to be cleaned- which is required by lawIt was admitted to my husband during one of his visits with management that the previous manager of this property did the walk through incorrectly and it seems that we are paying the price for the company's incompetent employeeHeritage Park is happy to try to hold you to the lease, but when the lease works against them they are more then willing to ignore it Regards, [redacted]

It indicates that the charges are minimum charges to turn the unit at move out. It also indicates the turn costs are the residents responsibility and will be prorated...

with the length of the stay. The lease was 1 year exactly indicating the resident is responsible for 100% of the turn cost. With that said we charged $112 for the carpet clean, which we are charged $82. This was an oversight on behalf of our community and will be adjusted accordingly to the new dispo, creating the credit of $30. The clean was a charge of $90 which was invoiced for $125. The paint charge was $200 and we charged on the dispo $80. With that said we are $155 out of pocket due to error in charging your account. We also did not receive final payment upon move out for final utilities in the amount of $152.88 for the last 45 days creating an outstanding balance of $152.88 at move out. All charges were associated with the lease that was signed by [redacted] and [redacted]. The total refund will be reflected in a new dispo we have emailed giving a refund of $95.12 instead of the original $65.12.

The lease states that painting for a 2 bedroom is $150 and we only charged $80 at move out which is less than half of the total cost.  We also did not charge the full amount of $125 to have the apartment cleaned and ready for the new residents we only charged $90.  All charges applied to the dispo are at or below the total cost to get the apartment move in ready.  We have reviewed this file and made the adjustment to the deposit refund for the carpet cleaning as stated in the previous reply.  We have submitted a request for a new check to be issued in the amount of $95.12.

It is clear from the photos that my apartment was not painted prior to my move in. As stated by an employee of Heritage Park during one of our many conversations, it would be "unethical" to charge me for painting considering the condition of my apartment upon move-in. Lastly, Heritage Park is still unable to provide me with a detailed, itemized list of what needed to be cleaned- which is required by law.
