Our real estate agent ended up costing us an additional $1400 because what we were promised was a lie because that is not what happened.On February 18, 2014 we began working with agent [redacted] to purchase a house. We closed on our house May 5, 2014. When we put in a contract on our home, the seller agree to pay closing costs up to $4100. We were promised numerous times by our agent that the homeowner's insurance would be part of the closing costs paid by seller. We informed our agent that our mortgage company required it to be paid in full before closing date. He continued to assure us that it would be even if they (agent and seller) went to our insurance office before closing to pay it. We also had to have a home inspection done and a re-inspection when the problems were corrected, for a total of $400. [redacted] told us because that was required by our mortgage company that it would be paid back to us in closing. The house appraised for $174 below the amount we needed.[redacted] said the seller would pay that at closing. On closing day, the seller did bring the $174 and[redacted] told the attorney that the insurance was prepaid. We got a check for $270 when on our closing papers showed that we should have received a check for $444. The difference is $174. So the seller paid the $174 and so did we. Two days later, on May 7th, we decided to call our insurance company to check if payment was made and it was not made. By that afternoon, our mortgage company was threatening to foreclose on us because this had not been paid as agreed.[redacted] informed us that he didn't know it needed to be prepaid even though he told the closing attorney that is was prepaid. Also,[redacted] informed us that he knew the seller was actually paying less in closing than he should have paid. We had discussed the homeowners insurance numerous times with[redacted] during our contract on this house. Each time we were promised that it would be taken care of by closing. After alot of back and forth with[redacted], he stated that it was an oversight on his part.[redacted] has been in real estate for 30 + years so I don't believe that this was an oversight. We don't believe this was an oversight because he even told the attorney it had been prepaid even though it hadn't been paid at all.[redacted] lied to us and to the attorney on this matter. When it was all said and done, we had to come up with $1232 by the following day to pay our insurance and to keep our mortgage company from going ahead with the foreclosure. Coming up with this amount would not have been so difficult if we had known about this from the beginning since we are both on social security disability.[redacted] was also informed of our income situation before we ever looked at the first house. This is why we kept asking him about our insurance being paid numerous times. In short,[redacted] lied to us.Desired SettlementThe two things he promised; homeowners insurance, $1232, home inspections, $400, total is $1632. We received $270 which leaves $1362 that he promised would be paid. This may have been a mistake on his part even though we don't believe so, but in life we all have to pay for our mistakes. We would be willing to settle for half that amount, $681. We think that would be only fair. We don't believe that we should have been out this amount because [redacted] had promised the insurance would be taken care of by closing. In reality,[redacted] should be responsible for the total amount as we shouldn't have had to pay anything as [redacted] promised we wouldn't considering he got nearly $4000 for his commission at closing. But we would be satisfied with half the amount refunded to us.
