When I came out for the original bid I asked the customer if she wanted a permit pulled or not, she asked me what the difference was and I responded that pulling a permit would cost more money and take longer to complete the project due to having to have the inspectors come outShe responded that
she didn't want to have it pulled because she didn't want to pay the extra money and wait the time to complete projectAs for the tools...I talked with my guy that was there and he told me that he didn't have a saw that he needed and told the customer he'd be back in a little bit because he had to run to the shop and the customer responded that he had one and that he could use it if he'd likeThe reason the shut off valves were installed was so the water didn't have to be shut off for the entire day as work was being done to replace a mixing valve for the shower since they were babysitting their infant grandsonWhen the homeowner called and said he'd like to have a permit pulled, I responded saying that was not a problem, but it could run upwards of $and I wasn't sure how long it would take since I was going to have to call a buddy of mine that is a master plumber and can pull the permit and perform the work neededThat evening I got a response from the wife saying they wanted to terminate the contract and was willing to pay me only $for work completedI responded with what the bill was for the demo of the existing tub and surround including the fees for the dump was, and for work completed to the bathroom was and offered to reimburse the differenceShe responded back saying she would except $I responded telling her I'd give her $shortly since I have my office manager pay out days on invoicesI'm sorry that this went the way it has, in years of being in business this is only the second time I've had a contract terminatedI hold a out of a star system with *** *** so it's not a common practiceI wish this could have been dealt with in a different matter as I was willing to get the permit pulled and complete the project

Our contract ended on April 28th, we came to an agreement of $refund on May 9thMy accountant and I pay out at days and they (Mrand Mrs***) received and cashed their refund check the first week of June As I stated before the very first time I showed up to give them an estimate I walked into the area to be remodeled with Mrs***, we went over everything she wanted to have completedAs we were discussing this I asked her if she wanted a permit pulled or notShe asked me what the differences would be and I explained to her the differences and she said she rather not pull the permit due to the extra time it would add to the project and cost I sent one of my guys there to start the demo (cut and remove the tile and drywall tub surround)He went there and got what he was supposed to get done completed and cleaned upThat afternoon I showed up and looked at the next steps needed to remove the step that lead up to the tub (we were trying to remove this step without causing damage to the adjoining wallsI sent one of the other guys and he removed the step and tubI came by after he had the tub disconnected with my truck and trailer with another one of the guys and we removed all the debris and tub from the siteAs for using Mr***'s tools, yes my guy did use a saw from him to remove the step as he did not have a sawzall with him and had said to Mr*** he was going to run to the shop to pick up a sawzall so he could cut out the stepMr*** went to where he stores his tools and brought back a few different saws and told my guy that he may use his saw to save a trip to the shop if he'd likeAs for the plumbing...when we opened up the walls the plumbing to the shower valve (which we were replacing) was a mess pipes were going all over the place and looked like shotty workmanshipWe talked to Mr*** about this and that we were going to cut it all out and make it look good and install the new mixing valveMr*** was watching their infant grandson and expressed he didn't want the water shut off all day, so we told him we could shut the water off and install shut offs that would allow us to turn the water back on to everything but the shower and the water would be off only minutes which Mr*** thought was a good ideaWhen we were going to move the drain (needed to be moved about ft to make it center of shower) we had to cut a hole in the shower floor (which is to move the drain) Mr*** stated he wanted a permit pulledI told him that was not a problem, but I'd have to contact the plumber I use when we pull permits to get him to pull the plumbing permit and complete the workI stated the cost of the project would go up possibly as much as $depending on the cost of the permit and to have a master plumber to complete the plumbing work that needed to be completedThat evening I got a letter from Mrs*** stating they wanted to end the contract and wanted a full refund minus $I wrote her back with a price breakdown for all the work we had completed and what we charge for that workShe wrote back and said she thought that was a bit high and stated she wanted $back which I agreed to and sent them which they did cashI've been in business in CO for years and always try to solve any problem as my record clearly shows between the Revdex.com and *** *** where I have a out of a star rating system

I have answered *** ***, I wrote him with the following message...As advised by my lawyer: As of July 2nd High Peaks Design has closed for business and is in the process of filing for bankruptcyMy lawyers name is *** *** with *** *** *** his number is ###-###-####
Unfortunately I do not have the means to pay back *** ***'s deposit as I'm bankrupt

I am rejecting this response because:Our contract terminated on April and we have not received a refund and ***'s response was not truthful.On the first day of work, April 25, a laborer came to demo a bathtub and tile surround He brought a pry bar and a hammer After approximately hours of work, he left for a different job site because he lacked the tools to complete the demo He said he had spoken with *** and that *** would come soon with a saw and vehicle to haul the trash that he had placed in the front yard *** arrived approximately hours later with a buddy, but without a saw or a vehicle for trash It appeared that his buddy would be doing the bathroom window replacementDuring their conversation, we realized *** intended to replace the window without obtaining a permit We cancelled the window replacement We were never asked if we wanted un permitted work done (window replacement requires a permit) and expected a reputable contractor to pull the required permits *** told us "the plumber" would come the next day.On the second day, a worker came with a Do-it-yourself type torch and minimal tools but no supplies He was definitely not a plumber and lacked expertise He made trips to *** *** for fittings Moving the faucet 20" up the wall should have taken less than hours but it took hours, including lunch and the trips to *** *** After struggling for hours to move the faucet, he installed shutoff valves, which made it possible to turn some of the water back on We did not ask for that.On the 3rd day, the "plumber" came to finish demo on the bathtub We texted ***, telling him the trash that lay in the front yard for days had to go *** and a buddy came and hauled away the trash, leaving a trail of broken tile, screws, and drywall across the driveway and yard I pointed out that demo was incomplete *** acknowledged it but it was never done He measured the area and told me he didn't think he could get a shower pan the size I needed but said he would be back in the morningApproximately hours work was done that day.On the 4th day, *** did not come The "plumber" came and cut a large hole in the subfloor, which we had to repair Over the course of hours, he made trips to *** *** and could not figure out how to relocate the drain He asked to borrow tools- a saw and a drill We refused and texted ***, requesting a permit be pulled He became argumentative and tried to talk us out of it, saying it would cost at least $extra and he would need to rewrite the contractWhen we expressed our concern re the "plumber", *** responded, "What do you care how long it takes him? You're not paying by the hour."That is when we cancelled our contract After researching construction worker pay, we believe the work received- fewer than hours, is worth approximately $13/hr Demo is non skilled labor and the "plumber" was also unskilled The new faucet was $Total is $value received We paid a deposit of $on March I have attached a copy of the email response from *** He quotes hours of demo at a value of $100/hr and the trash removal, not more than a pitruck load at $ We offered a compromise on May We offered to settle for a return of $That pays him $65/hr for labor and reimburses him for the cost of the faucet plus tax He did not respond We sent a certified letter to him on May 18, which he has yet to sign for On May 23, we received an email from him stating, "I'll have a $in the mail shortly." His response through the Revdex.com said he told us days He did not April was days ago If we are forced to go to court to collect, it will be for the full amount, not the good faith offer to settle for $

As I told [redacted] as of July 2nd 2016 High Peaks Remodeling is no longer open for business. We're in the process of filing for bankruptcy both business and personally. Unfortunately I wasn't able to complete his project due to closing down.
