Review: I purchased a popular used auto, 2005 Honda Odyssey EX-L in 4/13 relying upon advertised, personal assurances from dealer that I'd receive a 90 day warranty on "the drivetrain and more", van was in "great condition", passed "rigorous, MULTI-POINT INSPECTION (their emphasis in ad) and reconditioning process before being offered for sale;" "was properly cared for and maintained" "with a complete SERVICE HISTORY since it was new" (their emphasis). Also, they assured "Each vehicle comes with our assurance of satisfaction" in the web ad and in person, both considerations in my decision. Seller didn't provide me with Buyer's Guide per FTC and State law, I was given only a Buyer's Order of sale which states van was sold "As Is" w/o any dealer warranty despite advertised warranty promise being consideration in sale. Dealer verbally promised to back warranty promised in ad but wouldn't provide written, itemized version as required by FTC "Pre-sale availability of written warranty" Used Car Rule regarding warranty provision.

VA Code VA § 59.1-207.11. Warranty definition: "Warranty" means any implied warranty or any written warranty of the manufacturer, or any affirmations of fact or promise made by the manufacturer in connection with the sale or lease of a motor vehicle that become part of the basis of the bargain..." While specifics of a warranty that (in their words) exceeds the drivetrain remain unclear, I rely upon affirmations of fact (documented auto servicing since 2005, dealer inspections) and promises of performance (warranty protection, full satisfaction, full value of auto) to assert that my request is reasonable. The Federal Trade Commission Act allows the FTC to act in the interest of all consumers to prevent deceptive and unfair acts or practices. In interpreting Section 5 of the Act, the Commission has determined that a representation, omission or practice is deceptive if it is likely to:

• mislead consumers and

• affect consumers' behavior or decisions about the product or service

Among prohibited practices regarding consumer sales and misrepresentation in the VA Code are: 5. Misrepresenting that goods or services have certain quantities, characteristics, ingredients, uses, or benefits;

6. Misrepresenting that goods or services are of a particular standard, quality, grade, style, or model;

7. Advertising or offering for sale goods that are used, secondhand, repossessed, defective, blemished, deteriorated, or reconditioned, or that are "seconds," irregulars, imperfects, or "not first class," without clearly and unequivocally indicating in the advertisement or offer for sale that the goods are used, secondhand, repossessed, defective, blemished, deteriorated, reconditioned, or are "seconds," irregulars, imperfects or "not first class";

Their ad promised "complete service history since it was new" but I was told by dealer that to disclose such info was a violation of prior owner's privacy rights under law. Their "inspections" failed to uncover body paint damage to roof (which they reluctantly fixed weeks later), a worn water pump, accessory timing belt replacement (routine 90,000+ mile maintenance) which will run me over $1000, "balding" tires' replacement, several fluid flushes, other maintenance that will total near $1000 in addition to a significant cost a repairman stated could run $800 to fix the motor for the left side power door. I will reluctantly take the hit for the pump, belt and other items. At the least, I'd want them to replace the motor or otherwise fix the power door as part of warranty coverage, since they felt I "couldn't find another better equipped Honda Odyssey at the price we are offering." I paid $10,453 in all, paid in full and financed by the U.S. State Dept. credit union for this vehicle. State laws re: implied warranties hold dealers responsible if cars they sell don't meet reasonable quality standards. I believe it is reasonable that at the DMV's NADA assessment of this vehicle at $10,925 at purchase ([redacted].com), it should have working power doors.

Otherwise, it falls in line with "Nonconformity" defined by state law as a failure to conform with a warranty, a defect or a condition, including those that do not affect the drivability of the vehicle, which significantly impairs the use, market value, or safety of a motor vehicle. At the least, the door inoperability affects market value and use of a vehicle with otherwise high resale value. Finally, due to their failure to observe,record, repair glaring problems any reasonably "rigorous, multi-point inspection" would've detected, I believe it is fair to assume that these problems pre-existed the sale and they exaggerated their services. While I didn't detect these things until after separate post-purchase repair shop assessments, I shouldn't have to pay nearly $3000 in all for repairs for a vehicle sold above wholesale after advertised assurances that this van was above optimal for its price. They said I'd "buy with full confidence," their words, and find "pampered luxury" in this vehicle. Broken doors are not luxury at dealer retail price. All quotations are from their web ad, which I retained copies of.Desired Settlement: Dealer pays for repair of door motor, assures operability of left side power door at their cost. Unless 1 day repair, dealer provides buyer with loaner car during process due to distance from dealership. The latter is, of course, ultimately optional.

I am rejecting this response because: The seller insists that I purchased the auto with no warranty. I can (and will) forward Revdex.com and the business a copy of the internet ad which not only gave unspecified 90 day warranty but made assurances about condition of vehicle. Also, without a warranty, he advertised the vehicle as being in superior shape and stated verbally he'd take care of any problems. I told **. [redacted] that I had a mechanic check the functionality of van and he confirmed the defect. **. [redacted] did not pre-inspect the van prior to selling it to me. **. [redacted] did mull over a potential compromise where he stated that an auto shop in [redacted], VA could do the repair and that we'd split the cost 50/50. I am willing to entertain that option if he will negotiate with me. Thank you for your assistance in this matter.

Review: I purchase a vehicle for 5,999 and put a warranty contract for1,930. and the amound finance was 7,929.88. I had brought the car from [redacted] the sales guy. At first they did not send my information to the lender for about a week and half. Then when I check the automated system it stated that I own 11,999 dollars and my interest was 21.99%. I called [redacted] and stated how the heck can a 2004 vehicle with over 125,000 miles cost that much. He stated that it was the bank that did that. I told him that I have only 7,000 and some to be finance, which is written on my paper. He stated that is was on page 1 that he forget to give me, because I dont have page 1. He dont want to take the car back, and the bank representatives are no very friendly when I call about my situation. When I spoke to [redacted] at the dealership, he tell me what I am going through is life, and maybe I should have someone hit my car so the insurance could pay for. then he says oh I finance cars myself, and I said why did you not tell me , he said you did not ask. I told him that was unprofessional and I will callin Revdex.com. I was appalled for what he told me. I wanted another car. I purchase the car on 4/5/14 and it has a little problems going on with it, but to pay 11,999 it to high. The bank stated that they charge people that amount even if people have high credit. Now I am stuck with a 48 month loan. This guy [redacted] is a scam, unprofessional schemer, and I need him to fix my problem.Desired Settlement: have my contract rewritten
