From: Out West Construction [mailto:[email protected]] Sent: Friday, June 24, 10:AMTo: *** *** Subject: Re: Revdex.com COMPLAINT # *** Dear Mrs***:I am responding to the complaint filed by Mrs***I will start by saying, in my
opinion, this is an illegitimate complaintThis customer agreed to have me pour a stamped concrete patioThey approved the stamping patternThey also chose three different colors of releaseThey chose to have the concrete itself coloredThis process of coloring the concrete is a coloring agent added to the concrete at a small percentage, while being mixed. The steps I took to complete this job started with setting up concrete formsOnce the concrete was pumped into the forms, I floated the concrete and prepped it for stampingNext, I took the color release (the colors that the owners chose) and cast into a random pattern with a masonry broomThis pattern will vary from each installer, or vary depending on outside climate (wind, etc)This is a very abstract method for coloring the concrete (as in, no two slabs are identical)First a base color, then a secondary color, then the final colorAfter this process, then I stamp the concrete using a 36" seamless stamp pattern, that the owner approvedOnce the concrete is hardened for a day or so, then I went back and removed the excess release with a broom and leaf blowerLastly, I put one coat of sealer onAny additional sealer is the owners responsibility. When I showed up with a laborer to pour the concrete slab, the owner informed me that they wanted an additional slabThis meant I would have to do two separate poursI informed the owner of thisI returned and poured the first slab and finished it, as I described aboveThe next trip, I showed up and was met by Mr*** and he informed me that he was not very impressed with the mess that was left on his house from the concrete pumpingHe told me it was "slop"I assured him I would clean it offAfter I cleaned it off with my pressure washer and sealed the slab, he was very happy, complimented my work, and shook my hand numerous times. The next trip, I poured the final slab and stamped it, like I did on the previous slabI came back, cleaned off the release, and applied the sealerMr*** approved the slab and paid me the remainder of the balance dueSometime later, I received a message that the owners thought that the concrete needed another coat of sealerI drove down and applied another coat of sealer, at my expenseAs I was applying sealer, Mr*** was communicating via Facetime with Mrs*** (who was in Alaska) and showing her the completed slab and was complimenting my work to herOnce again, Mr*** was satisfied and I left in good favor.Mrs*** sent me a picture of the slab sometime later, and had a concern with the dark color release (nutmeg color, that she picked)I assured her, in my opinion, that it was just the picture and she would have to see it in personShe finally saw it when she got home from Alaska and we tried to schedule another meeting to look it overBy this time, it had snowed and we agreed to wait until the snow was goneWhen the snow melted, we rescheduled a meeting to look at the slabShe had messaged me a picture of what it looked like, but it wasn't a current picture, it was from the previous FallI showed up to look at the slab and instantly saw some drip marks on the slabThese marks were not present at the time that I stamped itI asked about them, but no explanation from her as to what happenedShe called them "pit spots" in her complaintMrs*** then tried to show me an area that she thought she saw "black spots"I couldn't see what she was talking about so she said "you can see it when it is wet"She then brought a garden hose and sprayed the slabAt this point, I could see the dark spots, but they were only the nutmeg color that she had chosenAfter this, we looked the entire slab over and she said she was happy with the first slab I poured, but the second one had issues she wasn't pleased withShe had done some research and had asked if I would apply a stripping agent and she would take it from thereIn order to help resolve the situation, I told her I would look into it with my supplierAfter talking to my supplier, he gave me a few suggestionsI responded to Mrs*** and told her I would strip the concrete at her request, but I wanted her to sign a release, releasing my business from any coloring issues, due to the fact that they would be taking over the coloring processThe stripping agent that she requested we use, would only remove the coating of sealer and not any colorThe color is permanently set in the concreteShe changed her mind again, and didn't want me to do thisI told her I could address the water spots, "pit spots", and try another technique for changing the dark color (nutmeg)At this point, I was working on an out of town job with no cell service and she could not get ahold of meShe changed her attitude on the messages to being very impatient and demandingShe threatened to file a complaint and I realized after 6+ trips to her house, I wasn't going to be able to resolve this. In Mrs***'s complaint, she has painted me as being an incompetent professionalShe also has implied that the products used on her project were sub-parBoth of these issues are inaccurateI have owned and managed a small business in Central Oregon for the last 15+ years with no other complaints from owners that could not be resolved privatelyPlease check my CCB dispute record to confirm thisI am a reasonable professional and could not make this customer happy. Mrs*** statement in the "consumer's desired resolution" is an opinion she has received from someone elseAs she has stated, she is not a professionalMrs*** request for a refund is completely unreasonable. Complaint: ***I am rejecting this response because:
?
my complaint in my opinion is not illegitimate at allI am not pleased with the way the concrete pad looksI would like to clear up one inaccuracy has statedHe stated that only when he showed up with his laborer to pour the concrete is when he was informed of an increase in the pad size which is not correctI informed him we had decided to go larger on the pad size Aug 24th and he told us that was not a problem just to draw it out on the ground so he could frame it inHe showed up with his son (aka: laborer) Aug 25th and they framed it outThe concrete was not poured that day at allI have no issues with it being done in two poursThe concrete truck was there and poured the first pad Aug 26thI have no issues at all with the colors that were used, for some reason in his response he felt the need to repeatedly keep saying I pickedNot denying at all I picked the colorsThey are the colors I picked outNone of these things are what I am unhappy about
What I am unhappy with is: the finish work, after he sealed the pads, we had to call him back within a few days because it appeared not enough sealer was put onWhen the sealer is broke down or to thin in spots, it appears as a chalk whitish spotHe did come back out and reseal itNo he did not charge us for it as he stated but I certainly would not have even expected to be charged? ? When the sealer is on, it gives the illusion the pad is wet looking almost a gloss finishAfter the second reseal my husband forwarded me a photoAt that time is when I noticed the big black spotsWhen I sent him the photo he told me it was just the camera and he assured me it looked fineAfter I got back and seen for myself and by the time the snow melted for us to look at it together it was April 7thAfter being snow covered from Sept to March the sealer was broken down againSo when he came to look at it, yes, I had to wet it down to show him the dark spots I was talking about and I also showed him pit spots that were concerning, and a few spots that appeared to be smooth where the stamp did not take.? I did ask if a different sealer should be used only because I had spoken with other concrete companies and they said you should only have to reseal once a year maybe a year and a halfWe had already had it resealed once since the original reseal and it was needed to be done again and it had been six monthsI also had asked the other concrete companies what could have caused the pit marksThey stated clumps in the release is what caused thatAt first it would not have been noticeable until the sealer broke down again and the powder flushed out due to water from melting snow/rainI also asked what could have caused the black spots and I was told from not being cast out correctly and basically too much release is concentrated in one area.? My second pad that was poured has big nutmeg colored patchesReminds me of a garage floor with big oil spots.? That is what I am unhappy with
I am sure he quit contacting me because he knows that the release is dried into the concrete and there is not fix for it without either coloring over or tearing up and redoingOn April 7th Jeremy was informed we were doing a bunch more yard work and was hoping for him to have whatever he was going to do done by end of April as we had other contractors coming out to do other stuff for usOn April 18th he informed me of a planI told him that is what will fix my black spot issue than lets do itI asked him when he would be outNo responseHe said I got impatient and demanding, stating he was out of service is why he did not respondWasn’t until May 6th that I sent him the message that I was upset and filing a complaintHe never made any attempt to contact me and knowing I was already unhappy and he knew we had an end of April deadlineI am sorry but if your? cell doesn't work, there are land lines? I do not think he is incompetent at allI just think he knows there is not much he can do to fix it and chose to ignore me in hopes I would go away.? And to me that is wrong
Pictures say a thousand words, so I attached a copy of the photo I sent him originally of the stamp pattern? and colors we liked that we got off the internetThe second two pictures are of what the pad looks likeI know if he was the customer he would not be happy eitherSincerely,*** ***
