This is in response to complaint filed by *** *** on 8/9/We received this complaint from Revdex.com on 8/10/On 8/13/we reached out to the consumer via email and received a response from consumer on 8/14/with additional information on the matter addressed in the complaintOn 8/17/
at 8:AM we spoke with consumer in detail about the matter.The primary complaint was failure for one of HighTechLending employees to respond to a number of requests by consumer to clarify and possibly fix some charges on her settlement statement for her home purchaseThere were three charges in question, with one of them being controlled by the lenderThis failure to respond to the consumer complaints agitated the situation and ultimately causing the complaint to the Revdex.com. The consumer will be sending in her documents to our review team to be resolvedWe are in routine communication with consumer and this matter will be resolved over the next couple of weeksThe consumer appears satisfied with this process at this time and is very nice about the matter to our research team.Since this matter will not be fully resolved within the days, please comment on how best to follow up at final resolutionThank you*** ***

This is an effort to put in chronologic order my attempt to get a reverse mortgageI am doing this because I want to warn everyone to avoid HighTech Lending of Irvine, Ca
It took me months and too much money before I fully realized that they were either crooked, incompetent or bothItems with an * indicates there are either emails or reports available
In when the housing market and economy plunged and there were numerous reports of banks being deceitful in their home mortgage lending I was worried but not yet but heading in the direction that a foreclosure on the house I was living and grew up in could be in the future unless there was a quick recoveryThen the bailouts started getting approval so I wrote my legislators both state and federal explaining my situationI was ignored by all except Senators Boxer and FeinsteinThey both directed me towards the HOME Program which was part of the TARP programs designed to help businesses, banks and other lenders and HOME was specifically for homeownersUnfortunately like most government programs it didn’t work and it put me in worse shape because it damaged my credit rating which took me a couple of years to repairBy the end of or beginning of I began looking into a reverse mortgage but was a little leery because I had some friends that had problems with them and wasn’t fully trusting of the lending industry
I logged onto a HARP website and filled out my contact information and almost immediately started receiving follemails and phone calls, yours includedThen the information about Harp lenders started arriving but since not all lenders offered reverse mortgages I weeded them outI read a couple fully ( One Reverse Mortgage and High-tech Lending) to get a sense of them but did not start crunching any numbers for a few more weeks and a few more offers by then I knew that I had to arrange for the mandatory counseling which was not as easy as I thought it would be but while I waited for some calls to be returned I started ranking the offers while continuously fending off you and others who wanted to know if I made up my mind (as a group you are persistent) in between I was able to schedule and complete the counseling and have the certification*Also I had ranked the offers and had you # and High-Tec #2, and my counselor had told me within certain ranges everything was negotiableBut before I called you I got a call from one of the persistent lenders at High-Tec (*** ***) and he said they were willing to waive many of the costs (approx$1500) and that moved them to the top
I met with a notary that High-Tec sent out and nervously filled out a lot of paperworkBeing afraid and asking the notary that this isn’t a contractShe assured me that it wasn’t but was required to be able to write a contract
The problems started shortly afterwardsI was told by High-tech that my deed needed to be changed from the *** *** Family Trust to *** ***, so I had to call the lawyer that wrote the trust and he told me that they were wrongWhen I informed them of this they said I would be getting a call from Core Value who did their appraisals and I should pay them and set up an appointment which I did.* On the day of the appraisal young woman showed up the one in charge said she was training the other one when I asked why there were twoSince both were afraid of my dogs, I had to lock up my dogs while they were taking measurements and picturesSo I locked the dogs in the house while they were in the back yard and they asked me to open the hot water heaters and then measured the backyardWhen we were done with the backyard I was told inside was next and then they would finish with the front yardI told them to go into the house and I would let the dogs back outside when I finished they were taking pictures and measurements inside the houseI continued with them but at no time did the one in charge say what they were looking for or what was a problemI went out in front with them where they continued with their measurements and then told me they were finishedWhen they left I was told High-tech would get the appraisal, I asked what if I wanted a copy and was told I would have to get it through High-techI did not understand since I paid and it was my home that was appraisedA couple of weeks passed and I received an email from *** *** with the appraisal and a list of items that needed to be addressed*
The water heaters needed to be double strapped,
Bathroom sinks needed to be fixed,
Crack in tile needed to be fixed and peeling interior paint on walls and ceiling needed to be sanded and primedThere were areas outside that were listed but only had to be done after loan was funded
I also need a report from a structural engineer and a Coalarm
The only good thing was the appraisal was million dollars
The next week I called *** *** to ask what I needed from a structural engineer and complained that there was nothing wrong with bathroom sinks the drains may have been dirty but they worked and that I had a Coalarm and the cracked bathroom tile was cosmeticHe replied that a licensed engineer had to say he examined the foundation and there was nothing wrongHe told me that when everything was taken care of to call and the appraiser would be called to re-examine my homeIt took about weeks for various reasons but finally was done and I made an appointment with the appraiser but on the morning she was supposed to call about minutes before she got there so I could move the dogs, she didn’tI let her in and told her she could look at repairs while I put dogs awayWhen dogs were locked up I walked her outside and removed water heater doors so she could see double strapping, I told her if they had explained things during first appraisal I could have told her both bathroom sinks worked and that I had a Codetector that was plugged in the bedroom I slept inI asked her if there was anything else and she said noShe went back inside the house while I let the dogs outside when I came in she had left the house had got in her car and leftMr*** sent me the appraisers report within an email that said he would call the following Monday*

I am not asking you to issue a citation. I want whatever your agency can apply for me to file a complaint against this company. The complaint is that they represented themselves as an agent that could assist in reducing our mortgage interest rate and help with refinancing our home.
They have al of our personal information which could be detrimental to us if abused. They have misrepresented themselvesHigh Tech Lending has copies of our bank statements, pay stubs, mortgage statements, and a credit authorization. I don't know if you can assist on having them return the documents, or f they are a legitimate company, to follow through with what they promised.Thank you,Mr*** ** ***

[Hightech Lending was aware of the income of Mr. [redacted] when the process first started in July, 2015.  Mr. [redacted] was already on disability at the time of the initial application and Hightech was we aware of this situation, had no problem with it and went forward with the application process.  The loan was approved and the net process was the appraisal.  When the company resended their offer, Mr. [redacted] informed Mr. [redacted] that he would have the appraisal fund refunded.  Upon attempting to reach Mr. [redacted], he is no longer at that extension.  We attempted to leave messages and there has been no response from Hightech Lending.

It is not the policy to refund appraisal fees when the borrower no longer qualifies for a loan. On 11/20/15, [redacted] spoke with Mr. [redacted] who informed Mr. [redacted] that he no longer is employed at [redacted] and is on disability and social security. Unfortunately, with the loss of income, Mr. [redacted] no longer qualifies for a loan and the loan was withdrawn. While this loan was challenging from the beginning, the company does not, nor can not, assume responsibility for fees incurred by the borrower in the course of obtaining a mortgage loan.
I hope this resolves this complaint.

Please accept this letter as our response and resolution to the complaint noted above.
Attempts were made, via email and phone calls, to contact the consumer through the dates 9/15/15 – 9/18/15 with no response from the consumer. The consumer loan documents were reviewed and the Branch Manager assigned to this file was interviewed. The consumer is complaining of “fraudulent practices” of which none were found. However, the consumer's loan file did take a series of events that caused the consumer frustration. The following is a brief explanation of this matter.
On, or about, 6/23/15, [redacted] applied for a mortgage with HighTechLending on his home in [redacted]. Within a week of his application, the loan originator handling the file was released and his desk phone line was eventually and incorrectly forwarded another employee resulting in a line that was no longer in service. This caused the consumer to become alarmed and to file the complaint with Revdex.com.
At the time, the volume of loans at the branch were unusually excessive causing general service and processing delays on all loans. The loan was a challenging loan that prevented it from being funded by HighTechLending requiring it to be brokered to another lender. The consumer was eventually reached in August with loan updates and the process was eventually put back on track. In reviewing the loan records, it appears that the loan should be out of underwriting later in September, however the outcome is not known.
The consumer also asked for all bank statements, paystubs, etc. to be returned for fear of identity theft. While the company would like to agree to this, it is a requirement that all consumer loan documents be maintained should they be selected for random audits by either [redacted], HUD, or the California Department of Business Oversight.
At this moment, I am confident that this problem has been resolved and that the consumer is properly being serviced again. We feel that this should close this complaint request. Please contact me with any follow up questions.
