Before I get into the details of Mr*** complaint I need to clarify that his home was built by Hill Country Villas, LLC. I have attached a copy of our construction agreement to verify this. Timeless Luxury Homes was in no way associated with his construction and should be removed
form the complaint Mr*** does in fact have some cracking in his asphalt driveway. He originally brought this to our attention in July of 2016. He sent pictures at that time and my Superintendent, Brian Box, traveled to the site to inspect and take more pictures. These pictures and Mr*** concerns were discussed with the Jerry Beisenbach, owner of CB Paving who installed the driveway originally. I have been building custom homes complaint free for close to years and CB Paving has built every asphalt driveway I have ever installed. They have been in business over years. I pride myself on my subcontractor selection. CB Paving is an exceptional asphalt contractor with an impeccable reputation. Jerry Beisenbach concluded that the cracks were caused by highly expansive soil conditions below the surface. It was dry at the time the asphalt drive was originally installed but shortly afterwards we received a significant amount of rain. Jerry Beisenbach recommended that the cracks be filled with an asphalt filler to prevent any future water intrusion that could cause damage to the surface. Brian Box shared this information with Mr*** On Saturday 1-21-Mr*** texted me separate times complaining about the cracks in his driveway. I replied to him on Monday morning with an email that stated the same opinion stated by Jerry Beisenbach back in the summer of 2016. Mr*** replied quickly stating that if nothing was done to repair his driveway I would regret my decision To summarize: there is no construction defect present at Mr*** asphalt driveway. The surface cracks are due to highly expansive soils below the surface. The compacted base and asphalt driveway were installed properly and I can assure Mr*** that both the road base and the asphalt will exceed any compaction test he wishes to have performed. If the asphalt drive were completely replaced, it would be a matter of tie before the new one experienced the same cracking. In fact, Mr*** closest neighbor has the exact same situation with the portion of his asphalt driveway that is in the same low drainage area, which was installed by a different installer.
