Response to complaint from *** ***:
This project had been completed the first time our crews were out to the property. Payment is expected upon completion. Again, please see terms and conditions that were signed by customer. If an issue arises, customer is to call or write our office to inform us of the issue. Issues are taken care of under the “Warranty” section of our proposal. Again, after receiving pictures of the project, our estimator and later our project manager inspected the driveway and a plan needed to be formulated for repairs. On August 15, 2014, our crew arrived at the project and instead of making repairs, a remove and replace was performed. We are now awaiting payment of said project which was due upon completion

 Complaint: [redacted]
I am rejecting this response because:
The contract says payment on completion. The job is not completed. What was I not told project manager was coming out to look at driveway so that I could speak to him about my concerns. Better talk to Estimator who came out because he said not to pay because job is not done. I have no problem paying for the work when it's done correctly.
The way they address problems, I will never get them back out there. I want to meet project manager and discuss issues with driveway and then we can discuss how much I will pay till they fix the problems. Right now holding back 10% is out of the question. There is also a dip in the driveway they do not address. If project manager would have got in touch with me, I could have pointed it out. The whole problem here is a LACK of COMMUNICATION on the part of Tibbs Paving.

 Complaint: [redacted]
I am rejecting this response because: They sent a sales representative out to look at the driveway. He agreed there were areas where water would collect. He was even suppose to come when it was raining but he canceled that appointment stating that he didn't want to be out in the rain. He was trying to sell us the option to repair instead of being held accountable for not fixing the driveway they put in. I have never received a call back, no restitution. All I want is for those three areas to be cut and redone. We actually paid more than $800 for our additional driveway, which has nothing to do with this so not sure why that was made in the previous statement.
They paved our driveway and part of it should have been repaired. As stated, when I started calling about 6 months after the driveway was done, I kept getting the run around and no one would call me back or pay attention to any of my messages. So here I am two years out of our warranty and still no one has addressed this. Had my original calls and messages been responded too, this would have been corrected within the warranty time. So I believe they purposefully ignored my calls and messages so that they would not have to come out and repair.

After receiving the complaint from the Revdex.com,  our vice president, David S[redacted] contacted [redacted]  on March 19 2015 and made plans to meet him at his home...

in Purcellville, Va. , once the wet weather stopped for a few days. We finally got our chance to meet on March 25 2015.   He showed me his areas of concern and asked what we intended to do to correct these issues. These issues are some asphalt cracking, some small areas that hold some water and an area of the driveway approx.. 48 x 60  that has a crack that runs the entire 48’-0” .
We intend to offer [redacted] the following corrective actions.   We will use an industry standard crack fill material to fill all existing cracks in his driveway. Once this procedure has been completed, we will apply a product called PDC ( Pavement Dressing Conditioner ) which will provide an additional seal on his driveway as well as making it totally black again. As far as the small areas that hold water after a heavy rain, this was known the day the asphalt was placed, however, Tibbs Paving gave [redacted] an immediate 10% discount on his Final Billing. I have been told that the  BIGGEST issue for this client is for Tibbs Paving  to "keep the lines of communication open” until we can resolve this situation to everyone’s satisfaction. We at Tibbs Paving fully intend to continue working with [redacted] until we can fully resolve this issue.

Please see attached signed contract, terms and conditions and warranty information.
Customer received a proposal dated 5/14/14.  Customer faxed signed proposal to our office on 5/19/14.  Work performed on 6/16/14 and billed on 6/18/14.
Customer sent pictures to our...

office to show issues with the driveway.  The estimator went to the property to inspect the issues and took pictures along with letting our project manager know there was a problem  The project manager went to the property to inspect the issues and formulate a plan for repair.  During our busy season, inspections for any issues may take upwards to two weeks.  At this time of year, new asphalt and 90 degree days, we do get complaints on "scuffing".  This is from lock wheel turn on the new driveway.  In [redacted]'s case, our project manager did see an edge crack.  No edge backfilling has been done - customer needs to see his "Care of Driveway" flyer.  There is a hairline crack in the turnout area in the driveway.  Tibbs Paving will address these areas with the homeowner under the warranty.  We do expect our customer to pay for the work performed holding a 10% retainage if issues have arisen.
We do apologize to [redacted] for our weak communication in dealing with this matter, however, Jason, our estimator and Ken, our project manager have been out to the property to reinforce our intentions to correct the issues mentioned.

I...

have reviewed the response made by
the business in reference to complaint ID [redacted]. The resolution
is accepted on the condition that Tibbs Paving will make permanent
repairs. It should be noted that any gravel substrate underlying the
original asphalt in the culvert area has been washed away and if the
intended repair would be made with asphalt, the gravel would need to
be replaced, along with the correction of any deficiencies which
caused the original asphalt and first repair to fail.
