The above resident was our lease holder, not [redacted] and she was not evicted but was served a notice of our intent not to renew the leaseThis notice was served within the guidelines of NY State law as well as the terms of our rental agreementOn the day that the resident vacated the ground was soft because of the recent rain that we hadThe pitruck used to move the resident's belongings was witnessed backing up onto the grass which subsequently got stuck causing damage in the area parallel to the walkwayThe resident was advised of the charges and requested to come to the office to obtain a copy of the attached landscaping invoice however, the resident never showedManagement is aware of damage caused by the snowplow in a different area of the lawn and the resident was not charged for such damageAttached you will find a copy of the non-renewal letter along with the landscaping invoicePlease do not hesitate to contact our office should you require additional information

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below
in my response to their letter, I haven't touched the grass lawn with my truck and I have never been stuck with the soft soil as they have mentionedI have carefully positioned my truck's tire to sit just on top of the concrete curb and never was on the grass areahow would I get stuck if my tires are on the concrete area where people use as a sidewalk? I have never set my truck on the grassy area, I don't know who's truck they witnessed that time, but as far as I know, I have witnessed the carpet contractor who repaired a flooded unit infront of our unit in the same building and the same floor backed their truck right before the doorsteps of the building, leaving tire marks on the grass lawn, it was not my truck at allwith regards to their statement that we were advised of the charges and requested to come to the office to obtain a copy of the landscaping invoice, WE WERE NEVER INFORMED ABOUT ITand had we been informed, I could have rushed to their office and questioned themi just remembered calling them about our deposit reimbursement since we have not received it yet but was just told to wait since it will take days to processwhen we finally received it, we were just surprised about the deductionalso, they intended not to renew our lease expiring 8/3/which we intended to renew several times with the previous management but was repeatedly informed that they misplaced our files because of several management transition(in nearly yrs staying, we have met managers already) Until they sent us a letter admitting that during a recent audit, they have admitted that there has been an oversight and informed us to communicate with them for the renewalinstead of sending a renewal form, they sent us a notice of their intent not to allow us to renewand now, they further harass us by charging damages we didn't dothis is unjust and clearly a very unfair business practice for us who faithfully pay our rent on time and we do not even complain about non-response on facility repairs or appliances not properly working or cabinets not even properly closing and floors with loud crackling noises everytime tenants upstairs walkwe would just want our $be returned and put to good use for our daily needs, this is just small amount for them compared to what we need to do just to raise that amount for us
