This letter is in response to the complaint you have received in your office from [redacted] Mr[redacted] applied for and was issued a $50,Year Home Certainty term plan issued July 18, Enclosed is a copy of the signed Application for Life Insurance, Authorization for the Release of Medical Records, Bank Draft Authorization and other related forms for your review.Mr [redacted] called our office on August 24, requesting cancellation and refund of premiumsThis was the first know we had of Mr [redacted] 's desire to cancelWe advised him we would remove from the automatic bank draft and send our Policy Cancellation Request form to be completed and return with his request for a full refundThis form was mailed on August 24, (copy enclosed).In the interest of customer service we have cancelled Mr [redacted] 's policy as of the original issue dateEnclosed is a copy of our refund check that has been mailed.If I can be of further assistance, please contact me [redacted] ext or by email at [redacted] [redacted] ***Policy Service Department

We are sorry to hear Mrs [redacted] has rejected our response We must issue a policy based on the application that is completed and signed by the policy owner The application clearly did not indicate for a disability rider to be on her policy As previously advised, the claim she filed was on a pre-existing condition that was not disclosed on the application and would not have been approved even if she had the disability rider on her policy We have cancelled Mrand Mrs [redacted] 's policies as of the original issue dates and refunds of all premiums received were mailed September 19, to their home address

When ** [redacted] completed his application for insurance on April 25, all of the health questions on the application were answered in the negative When he completed the recorded telephone interview with our vendor EMSI, he answered all of the health questions in the negative with the exception of a heart condition In issuing the policy, we relied on the answers given to the questions on the application for insurance and telephone interview.Due to his death within the year contestable period on the policy we obtained medical records for ** [redacted] that were prior to the application date as we do with all claims filed in the contestable period A comprehensive review of his medical records indicates there was health history that was not disclosed at the time of application This information was material to the risk to be taken by American Amicable Life Insurance Company of TX Had questions #and #on the application been answered "yes" he would not be eligible for the plan of insurance applied for and a policy would not have been issued.We regret that our original claim decision cannot be changed The decision is based on the information, facts and circumstances known to the company at this time The company does not waive its right to present other defenses to this claim, which may come to its attention in the future It is requested ** [redacted] review this response and the statement of facts it contains If he thinks that anything is inaccurate or incorrect, or if he would like to present additional information, we will be happy to discuss or review

We have been in contact with Ms [redacted] regarding the claim for benefits on her mother The policy in question was issued effective February 3, based on an application for insurance with negative answers to all of the heath questions Ms [redacted] died February 11, with the cause of death listed as undetermined days after the policy was issued Our records also indicate the first premium for the contract was returned unpaid by her bank.We have made several attempts to obtain medical records for Ms [redacted] without success We are currently holding for two outstanding medical reports As Ms [redacted] states in her complaint, she has contacted us several times but is unwilling to make the effort to obtain EOE paperwork in order to assist with obtaining the medical documentation.We will notify Ms [redacted] as soon as the medical documentation is received, reviewed and we are able to determine if Ms***'s health history was as stated on the application for insurance If all questions were answered correctly we will be able to process the claim

insurance applications and other related documents for your review.We did receive a claim form in our office on September 6, for Total Disability Benefit completed by Mrs***Her policy was reviewed and the claim was declined due to her policy not including the Total Disability Income Rider as it was not indicated on her applicationAlso, according to the Policy Holders Claim Report, this was preexisting condition prior to the life insurance application being completedTherefore, had the application included the Total Disability Income Rider, the benefit would not have been approved since it was a preexisting condition.In the interest of customer satisfaction, the above policies have been cancelled as of the original issue date and all premiums received are being refunded to the customers.If I can be of further assistance please contact me *** ext *** or by email at ***

PAPERWORK, OR WORD ITI'M WANTING AND NEEDING AND ANSWER TO THIS SIMPLE MATH QUESTION! I WAS HAVING $BI MONTHLY SENT TO THEIR CENTRAL NATIONAL BANK, 001916555E/001916555F, NOW EVERYTHING IS NOT OK. I AM LOOKING AT $PUT INTO THIS BUSINESS, EXPLAIN OR HAVE THEM EXPLAIN THIS TO ME, AFTER INVESTING $AND MY REFUND IS AND IN THE OTHER, PLUS STILL HAVE NOT RECEIVED THAT.SINCERELY

I am rejecting this response because: why did they do a telephonic signature with my mother, knowing the hospital medical records do not accept telephonic signaturesAnd no I will not take time off from my job to obtain EOE, when they should have had my mother to physically sign the documentationmy mother lived in Birmingham Alabama, and I would have to take off from work to go there from Atlanta Ga.I do not know when the policy was obtain, but I'm sure if my mother knew she was going to die in eight daysreally wowand she missed a paymentwhat are they trying to insinuate, when they do get the medical records please send me a copy so I can see exactly what they are trying to say.or what they are trying to accuse my mother of doing. No matter what this is worst company and I will never recommend it for nobody
