We closed on this house 8-28- Prior to closing a home inspection was done & all items were resolved before closing A walk-thru was also done before closing After closing, I responded to EVERY call and text immediately & my husband met the roofer at their house to make
sure he showed up & job was done It had rained so hard that some water came in thru the ridge vents (time) On January 7th, 2016, I was called about a possible leak in master shower I immediately called plumber & he went the very next morning I did not hear from them again till around the 1st of March saying the shower was still leaking (almost months) I again sent my plumber back to their house on March 4th, a Friday because he's off every other Friday I had to schedule on his day off Then on June 23rd, I got another text saying shower still leaking It's been over months & I'm just now being called He wants to set up for plumber to come July 8th, another weeks out This would be the 3rd time for plumber & he does not understand what's going on I told him to change out the fixture if need to Do whatever it takes to stop the leak By this time it has damaged the base boards by the shower As per Miss Code of New Home Warranty Act 83-58-(2)(d) the builder's warranty shall exclude any loss or damage which the owner has not taken timely action to minimize They received a copy of this @ closing But, I still got my plumber to fix the problem & I scheduled for some sheet rock repair & I personally was going to go paint but they did not want me to come At this time, I have no painter If this had been brought to my attention in a timely matter then these other issues would not exist I was responding to every text & call until I found out from some of my other clients, in this same subdivision, that they were trashing my company & my name on Facebook & now have to explain my actions to you. *** ***Hilton Properties, Inc

I am rejecting this response because:1. The wood floor has a few spots that are in need of repair from installation. This item has not been addressed in the builder’s response and remains in need of repair.2. Areas that need to be painted due to sheetrock repair. This includes the garage which had a leak. The sheetrock in the garage was repaired but it was never painted. The builder was aware of this and left the job unfinished. When we reminded her that we had a few areas that need to be painted as a part of the punch list that was never finished, she, after several requests stated that she would paint it herself. Each time she suggested this, we advised her we prefer a professional to finish/touch up the job that was begun by a professional. She never responded to our requests for a professional. The wall in the master bathroom (not water damaged spot) needs to be painted because the plumber had to cut a hole in the wall to make one of the repairs. The sheetrock guy fixed this and an area in the dining room, both of which also need to be painted. We will be happy to wait a reasonable amount of time for the builder to obtain a painter to finish/touch up our house.3. Damage to sheetrock and baseboard due to water leaking in master bathroom shower. All repairs should be done by a professional and should be completed in a timely manner. The plumber made 4 repairs to our leaking shower before finally (I assume) fixing the problem. I, nor my husband, are plumbers. Each time, the plumber came and attempted to repair the leak, he told us it was fixed. Sometime after his first attempt to repair, the wall began to show discoloration and the baseboard began to look and feel textured which I then discovered was a result of water damage. Up until this point, we assumed the leak was fixed because the plumber had said it was. We called the builder again and had the plumber come out again. This happened 4 times. Each time the plumber, a professional, told us the leak was fixed and of course, we believed him. Any follow up by the builder after a visit from the plumber consisted of “Yes, he came. Yes, he said he fixed it.” We also went above and beyond to attempt to solve the problem and reduce further damage by using an industrial type fan for drying and cardboard to see if there was still a leak and where it might be coming from. The leak was not fixed until my husband and father found the source of the leak on their own and notified the builder and plumber of where they thought the leak might be. We contacted the builder about these items on multiple occasions but typically when 3 repair items were mentioned, only one would be responded to. We have been trying to get fixed since shortly after we moved in. Towards the end of the one year period, we made great attempts to have these issues resolved before the anniversary date but often received only the response that the floor guy could not be reached via text. Other items were not responded to and no other efforts were made to contact the floor guy. Assuming in good faith that these items would be remedied by August 28th, we tried not to bombard the builder with our requests. Extending that courtesy, however did not work because items continued to go unaddressed. Regarding the comments about trashing the business on Facebook, that is untrue. A single post was made on a closed group, private neighborhood Facebook page that we were nearing the 1 year mark since closing and were having trouble getting the builder to complete the job. It was a warning to other new homeowners that they should get their punch list/repair items fixed as soon as possible due to our experience with ongoing issues. We had heard of other neighbors who had purchased Hilton homes experiencing the same issues and were attempting to help other buyers avoid the problems we have had.

These items are being taken care of.   Is this sufficient or should I explain in detail.  I don't agree with what she is saying but I am going to take care of them.  It's hard to not let emotions get involved when she is not being truthful. but I also realize that's not what you're trying to resolve.     Thanks, [redacted] Hilton Properties, Inc.
