I am rejecting this response because:
 There are factual
inconsistencies in the response from Steve Hinckley of Hinckley-Vonpertz
Plumbing Inc.
 
Regarding Item #3 of the
response, "they" did not explain our water main had been broken in
two places and neither my husband nor myself were shown two repairs and
"ok"ed them.  The statement, "...we were not to back fill
or cover up the repairs so that her husband who is a contractor could look at
it," is factually incorrect.  I asked the crew if they could leave it
open so my husband could take a look at the repair, I didn't tell them they
were not to back fill or cover up the repairs because, I was told of only one
area where our water main was damaged, not two.  I wasn't informed there
was a 2nd area of damage until my phone conversation with Steve Hinckley on
April 6th, 2017.
 
Mr. Hinckley has not mentioned in his timeline
my conversation with his work crew the day of the inspection when they let me
know we'd no longer be inconvenienced because the inspector was coming to give
the final sign-off on the work they'd done.  I asked them at that time if
they had the area open where the repair was so the inspector could see the
repair and the crew member pointed to where he was working and said yes it was
right there and that my husband said he wanted it left open so he could take a
look at it.  I told him I thought my husband already looked at it (and took
photos) but, I wanted to be sure the inspector saw it and signed off on it, and
I asked him if we'd be getting something from either his company or the county
verifying the inspector approved the repair and he confirmed we should be
getting something.
Mr. Hinckley's crew did
backfill but, didn't compact the area and much of the "fill" was
still piled up alongside the excavated area (much of it shows chunks of asphalt
that was dug up during the excavation - we have photos on multiple dates to
verify this).  When the first Winter rains came in January we started
seeing just how poorly the "backfill" work was done.  Ruts
started to form alongside the easement driveway and chunks of asphalt started
to break away from the edge of the asphalt driveway where the excavation took
place.  When Mr. Hinckley refers to "completed clean up" he
leaves out the fact that the excavation left behind piles of loose dirt,
displaced gravel (from around the mailboxes) and chunks of asphalt removed from
the easement driveway.  I do not know where there is a "concrete
patch," but they did patch the asphalt only across the driveway where they
saw-cut through it to get to the water main.
 
I did call Mr. Hinckley
nearly 6 months after he did the work on our easement but, only after repeated
efforts to first get the gentleman who contracted him (our neighbor) to resolve
the poor workmanship by contacting his contractor and getting it fixed.
 Each time I attempted to get the neighbor to pay attention to the erosion
that eventually led to ruts nearly 2 feet deep and now showing the water main
lines (photos have been sent to the Contractor's State License Board and Surety
Insurance) resulting in a health & safety hazard along our easement, the
neighbor responded he'd have his landscaper take care of the problem.
 Since this neighbor doesn't live at the home next door (tenants have been
living there for years), I realized I would have to resort to contacting the
contractor, Hinckley-Vonpertz Plumbing Inc. directly, and at that time, realized
I never received a confirmation about the work performed or that it had been
approved by the inspector with the County of San Diego.  I contacted the
county inspector and he informed me he'd never been told our water main had
been broken and because he didn't see any obvious water in the trench, he did
only what was required by the permit, inspected the water main line for the
neighbor and signed off on the permit.  When I contacted Mr. Hinckley, I
informed him of this and he stated he'd have to get back with me, called me
back the next day to let me know he believed it was his son I spoke with and
that he didn't remember having a conversation with me about the inspector
looking at our repaired main water line or providing us confirmation of that.  He
asked me what I wanted him to do now that the hole was already filled in, and I
let him know that it may have been filled in but, not compacted correctly and
now the rain water had washed away the excavated areas and left our water mains
exposed and ruts nearly 2 feet deep that posed a health & safety hazard.
 He said he'd go out and take a look at the easement and get back with me.
 He also, in that conversation, let me know he'd provide a warranty and
description of the work performed via mail and I gave him my address.  I
also gave him my email address and asked that he send me an electronic copy as
well and he said he would.  It should be noted it was during this
conversation (April 6th, 2017) Mr. Hinckley informed me about a 2nd break in
our water main line.  Up until this conversation with him, my husband and
I were not told of a 2nd break in our water main line and we were never shown a
2nd repair to the line, hence the reason we have only one photo of a repair to
our water main line and measured the distance from our property line to that
repair.  We have no idea where the 2nd break occurred and we've never
received any information from the Hinckley-Vonpertz Plumbing company about
where or when that break happened.  
 
To this date, I still
haven't received any response from Steve Hinckley of Hinckley-Vonpertz Plumbing
Inc., either through USPS mail, email or a return phone call from my last
voicemail message to him on April 25th.  The easement remains in disrepair
and as the rains progress the damage continues; the asphalt continues to erode
from the edges of the driveway and the ruts are getting deeper, the water main
lines are still exposed and no one is taking responsibility for this damage.
 I have informed the neighbor multiple times over the past six months of
the condition of the easement as a result of the excavation by the plumbing
crew he had working on the easement and he has yet to return the easement to
the condition it was prior to the work performed.  It also appears the
Hinckley-Vonpertz Plumbing, Inc. company is not willing to take responsibility
for their part in returning all the portions of the easement they worked on to
the condition it was in prior to the work performed.  I consider the
resulting hazardous condition the easement is currently in to be as a result of
poor workmanship on the part of the plumbing contractor Hinckley-Vonpertz
Plumbing, Inc., and neglect of the care and maintenance of the easement on
the part of the neighbor/homeowner who contracted Hinckley-Vonpertz Plumbing,
Inc., to repair and replace his water main line.  As a result of the lack
of response from Hinckley-Vonpertz Plumbing Inc. to date, and the insufficient
response by the homeowner sharing our easement, I have referred this issue to
the State Contractor's License Board and at the direction of the board, the
bond company that insures this contractor.
