I am rejecting this response because: Hindsite does not understand the complaint I am filing against them.I was complaining that they do not answer emails, return messages or phone calls, and ignore former tenant’s complaintsThey claim that they only respond to written notifications, yet it clearly says on the bottom of the letter that questions are to be sent to their address OR via their email (attached is the letter)I was also told to use that email address when I first stopped by their office on Oct 17thIf sending them a letter was an issue, this should have been stated earlierInstead, I was ignoredAlso, the email communication that they provided was incompleteI have attached the email stream that I’ve been using since my original complaintIn it you can clearly see that my messages reflect my frustration, increasing with each message sentOn NovI even said that I am going to have to escalate the matter furtherIf that doesn't tell you I need a response what does? The only time I heard from them was after I sent them a certified letter threatening legal action.Looking at the video is the only way to clarify the charges because many of the claims they are making are falseOn their list they claim that the blinds needed to be clean, but there were no blinds in the house we were staying inThis makes me think that they are not being truthful and adding claims in order to exacerbate the charges against meTheir attorney has had ample time to let them know if they can release client videosThey have been aware of this issue at least since March 2014, from a previous complaint filed to the Revdex.comI have seen other claims against Hindsite for lack of prompt action and unnecessary charges from other tenantsThis has fueled my resolve to get to the bottom of their systemic issues in property management’s handling of security deposits.I have a right to know who is holding the remainder of my security depositThat is why I am asking for the owner’s contact informationThis matter should have been taken care of months agoInstead Hindsite has used ignorance and stall tactics in the hopes that I will just go away

Dear [redacted] and [redacted], At the time you moved out, neither you nor [redacted] provided us with a written forwarding address which caused the delay in refunding your security deposit to you within 30 days after you vacated the property on July 31, 2014.  As a courtesy our move out instructions...

reminded you to send us your forwarding address in writing so we could refund your deposit.  Once we received your forwarding address on September 5, 2014, the 30 day timeline began and we returned your deposit within 30 days from that date and meet the lease term obligations.  The form that was sent to you at that time explained the amounts deducted from your deposit and on December 30, 2014, further information was sent to you per your request (see attached).  You first reached out to us on October 17, 2014, questioning the deductions made, and I replied to you on October 20, 2014 that I would look into the matter and get back to you.  On December 5, 2014, I received a follow-up letter from you asking about the status and I replied to you on December 30, 2014, and notified you that I was able to get approval to refund you a portion of the deposit that had been charged to you for the removal of the curtains that were hung with the spring-loaded curtain rods.  Those items were left in the closets of the property for Tenants to utilize and although you did not remove them from the windows and leave them in the closet as found at move in, we went ahead and refunded you $35.00 deduction made for the removal of those items.   In regards to the cleanliness of the property at the time of move-out, our video documents several places that were not left in clean condition through out the property.  I have attached your Inventory and Condition that shows you did not notate any part of the property that were not properly cleaned when you moved in.  I have attached the cleaning bill we received from the vendor that cleaned the property and I listed below all the places that we found to be dirty at the property that are documented on our video: 1. Exterior of windows in the front of the property, cobwebs present and not wiped down/glass dirty.2. Front porch not swept, door had cob-webs and several areas of scuffing.3. Exterior of windows on side of property – cobwebs/glass dirty.4. Area under carport not swept.5. Back windows glass was dirty.6. Exterior of windows on opposite side of property (kitchen side) - cobwebs present and glass dirty.7. Side door with doggy door had muddy dog prints and glass on window was dirty too.8. French doors had dirt around the trim and windows were also dirty.9. Tile near french doors had dirt and hair. 10. Flooring in living room had dirt and hair through out. Mainly in corners and flooring did not look swept or mopped at all.11. Living room corners had cobwebs.12. Living room blinds were not wiped down.13. Blades on the living room ceiling had dirt/light fixture on fan also was dusty. Cobwebs present as well.14. Window sills in living room for all windows were also not wiped down.15. Living room baseboards had a lot of dirt build up on the tops of them.16. Kitchen counter tops had film on them, not wiped down.17. Kitchen window sill not wiped down, dirt present.18. Top of Fridge not wiped down and inside had food particles.19. Hair on washing machine on the lid and on the outside of it.20. Dirt/hair present next to washer and various places on kitchen floor.21. Kitchen drawers had dust and hair left behind, not wiped down.22. Pest droppings found in some kitchen drawers – No charge for pest control was charged out of deposit.23. Top kitchen shelves had stains from cups and were left dusty and dirty.24. Outside of microwave had grease splatters.25. Glass dirty on the inside of the stove and bottom portion of the stove was also dirty; pizza pan was also left inside.26. Hair found on front of stove.27. Hall bathroom – soap sm present on tiles in shower.28. Hall bath toilet had dirt and hair around base and stains behind it.29. Hall bath medicine cabinet was also not wiped out.30. Dirt/Hair on floor in front of A/C (hallway).31. 1st Bedroom – Sweeping needed, Fan blades and light fixture dusty/cobwebs. Windows not  cleaned. Hair present on shelves in closet.32. Hall closet had dark stains in the back corners; needed to be mopped. Shelves were dirty with dust and hair too.33. Back Bedroom (left) - needed sweeping.34. Master – windows were dirty, not wiped down. Dark smudges on the walls. Ceiling fan    blades were dusty. Shelves in the closets not wiped down.35. Master bath- shampoo left behind in shower, fixtures not wiped down(soap sm present). Sink had glove and drain catch full of hair left behind. Toilet had dirt around bottom and back side dirty too. In addition to the cleaning that was required, prior to your move-in the entire property was repainted as well as textured (all holes and cracks repaired).  When you vacated there were several walls in the living room, kitchen, hallway and bedrooms that had spackle on them from where someone attempted to cover holes made to the walls by either nails or screws.  This spackling made it necessary for us to repaint all of these areas. Had you simply removed the nails, and not spackled the walls it may not have been necessary for us to repaint, but once someone spackled that was no longer an option.  As per paragraph 17. Property Maintenance, Sec D. (#3 and #6), Tenants are not to make holes in the woodwork, floors or walls, except that a reasonable number of small nails may be used to hand pictures in sheetrock and grooves in paneling. Tenants are also not to alter, replace or remove flooring materials, paint or wallpaper.   As explained in my prior email to you, the 8% fee that was added on to your final charges is a fee that is part of the Owner’s expense for handling the items that were deducted from your deposit.  We could have included those fees with each amount billed, for example cleaning bill $189.00 ($175 + 8% fee) but we like to be as transparent as possible when making deductions.  Because the repairs/cleaning required at the property were caused by you and the Owner incurred those fees via your actions, they were deducted from your deposit.  Had none of these items been required, there would have been no fees.    Also, our standard policy is to only communicate in writing with tenants concerning Security Deposits and this was in the letter that was sent to you with your initial security deposit refund.  In addition, we do not give our the Landlords personal information, nor are we obligated to share data gathered for the sake of the owner with you, nor are we required to go through any additional expense to give you access to this data that is posted on a site that has very limited access.  We are in conversation with our attorney about the legality of making client privileged information available to the tenants.  Therefore our current policy is that we do not give tenants access to videos.  With that being said, we are declining the request to set up a meeting with you to watch the videos.  We are considering this matter closed and have copied the Revdex.com on this email as per your complaint filed with their Agency.
