Agency Title performed a title examination for Mrand Mrs*** that we closed on March 6, It typically takes to weeks after closing to get the Deed recorded, receive it back from the Clerk's office, prepare a title insurance policy and mail the deed and policy to the buyerIn this
case the deed and policy were mailed May 13, The delay was a result of there being a mobile or manufactured home on the property (which is personal property) which needed to be converted to real estateThis is done by voiding the title to the home (same as a car title) and filing the voided title with an Affidavit of Conversion in the Clerk's officeThe seller of the home and property did not have the title to the home with him at the time of closingIt took him several weeks to get us his title, which delayed us getting the documents to the Clerk's office to be recorded, and thereby delayed us getting the documents and title policy to the ***sWith regards to the deed in question, the legal description properly conveyed the real estate to the ***sProperty is conveyed by legal description, not mailing addressThe purpose of the mailing address is to inform PVA and the Sheriff where to mail the real estate tax billThe address has nothing to do with whether the property is legally conveyedIn this case we wrote in the address as*** *** *** ***It should have said *** *** *** **When the ***s contacted us and pointed out the error they demanded a new deed be preparedA new deed or Deed of Correction is not necessary to correct this minor mistakeAll that is necessary is to call PVA and have them correct their records showing the correct address to mail the tax bill to, which I didBecause the ***s were so demanding that we prepare a new deed, which I know from years of experience is not necessary to correct this ministerial mistake, and requires all parties to gather before a notary public to re-execute a new deed and then record it, I prepared an Affidavit and recorded it in the Clerk's office, that states the original deed had an incorrect mailing address and then states the correct mailing address for the ***sIt is now a matter of public record that the correct mailing address is *** *** *** ***It has the same effect as a new Deed or Deed of CorrectionIt's just a simpler way of correcting the errorAfter recording the Affidavit I called PVA to make sure their records have the correct mailing address, and they confirmed they doTherefore, the minor error has been corrected, the ***'s have legal title to the property and the home, they have an Owners Title Insurance Policy, and PVA and the Sheriff have the correct address to mail the tax bill toI apologize for our mistake and any inconvenience it may have caused, but we did our jobIf the ***'s hire an attorney to prepare a new deed because they think its necessary hopefully the attorney will be honest and tell them its not necessaryIf he doesn't the ***s will be throwing away their money unnecessarily

 We did not hire a closing company to provide us a deed with an amendment filed separately. We paid in advance for one deed without errors on it.  
 When we received the copy of the deed they recorded and saw their error, we called them immediately and asked that the deed be corrected.
We did not want or ask them for a recorded amendment. 
 Never were we asked if this would be acceptable to us to fix the error they made and their attorney reviewed and approved prior to recording.
According to the county clerk a new deed with errors should have a corrected deed made and recorded not an amendment recorded after the fact.
We simply want what we paid in advance for from this company. 
We should not have to pay additional fees for a copy of a second recorded amendment to include with our deed that is in error to have all the paperwork for our home.
 
Agency Title should provide us what we paid for or return the money so that we can obtain a corrected deed.

Response:
Even though we previously resolved the matter and corrected our mistake, I am putting a Deed of Correction in the mail today to the [redacted]s, together with a check for the recording fee.
