Complaint: [redacted] I am rejecting this response because: Buyer contacted MUD office prior to contract signature back in Statement from MUD was that facility had pumps running only 3-times a week for 30-minutes each time Community is gated and closed off during non working (non construction) hours Lot was last lot of community with construction constant all around Opportunity was not present to witness zero outside noise at site prior to contract signature Buyer made every independent effort to investigate facility K Hovnanian withheld information that buyer directly requested Buyer only discovered noise consistency by requesting a technician to the facility and talking to the low level facility employee K Hovnanian acted unethically with intent to misguide for financial gain at expense of consumer causing loss of finances, stress, pain, and anguish Regards, [redacted]

KHovnanian Homes Management has been working closely and directly with the OWNER of the home Unfortunately the tenants of the home have been impacted by the issues KHovnanian has spoken with the owner and his response [in part] to KHovnanian was: "Again while I apologized to the tenants for having to deal with so many repairs and modifications during the one year tenure in the house Khov and [redacted] did all they could to make things right under the circumstances and all I could do was to modify the rent and wait for them to vacate so that a comprehensive repair could be made in a vacant house which the company promised it would do."We are committed to addressing the problem.Thank you,KHovnanian Homes, [redacted] Division

Thank you for giving us an opportunity to respond to this issue The tile installer has inspected the problem, acknowledged the need for a repair, and agreed to completely replace the tile and grouting issue in the manner requested by the home owners The appropriate tile has been ordered and should arrive later this week KHovnanian will schedule the tile and grout repair directly with the homeowner KHovnanian Homes

Dear [redacted] I have reviewed your complaint I understand your frustration and apologize for the amount of time it has taken to resolve this concern Once the construction defect was proven we should have acted in a more timely and organized fashion It is my understanding that the storm water discharge pipe was blocked, broken, or otherwise not working While the process was frustrating it appears that part of the concern has been resolved In order to accomplish this part of your driveway was replaced According to your complaint you have the following issues with the work to date: Concrete spoils that have been placed at the end of your driveway have not been removed You are concerned that the concrete installed has been discolored either during the install or the next day while it was sawcutYour landscaping and grade at the driveway and in the trench that was worked on has not been restored KHovnanian Homes, Cleveland is committed to removing the concrete, assessing the coloration of the driveway, and restoring the grade to the areas worked on Meaning at the driveway and in the trench We are committed to completing these tasks no later than 12/15/ Based on our phone conversation (12/5/2017) you stated you would prefer to install your own grass I am agreeable to reimbursing you for the required seed and straw to accomplish that task I require an estimated cost prior to your purchasing the material that I may agree to, and a receipt of purchase in order to process the reimbursement You have stated concern about the grade of the property at a side swale KHovnanian homes warranty does not extend to the property grade beyond one year The term settling, and the settling that is covered during the warranty period of one year, refers to the settling that is common in backfills and utility trenchesRK, Senior Construction Manager; KHovnanian Homes

While we understand that this has been an ongoing challenge from both sides, KHovnanian is committed to providing our customers the products agreed to at time of Contract With that, our trade is prepared to install the Home Automation System and we have shared this with the homeowner We understand that the homeowner does not wish to work with the original Trade installer and we have contracted another to complete the work We are hopeful we can complete the install within the next two weeks Please contact our Warranty Department when you are available to schedule the completion of this workKHovnanian Homes

Thank you for giving us an opportunity to respond to [redacted] complaint Our corporate office and Warranty Call Center have all received the same complaint, and we jointly respond as such [redacted] driveway is what is considered a single wide drivewayHis driveway width is in alignment with the other single wide driveways within the communityAdditionally, the area that is "too high" that he refers to is within the specifications of the approved site plansWe have made repairs at other homes within the Community however that was due to those driveways not being the required widthIn light of the above we will not be making any repairs to the driveway of this home
