I am writing to you in regards to a complaint that was submitted to you in regards to my business.  Mr. [redacted] brought his Mercedes Benz to our repair shop for diagnosis of his driveability concern that he was having on or around 8/29/14. When the vehicle came in it would not stay running...

unless the throttle was being held to keep the vehicle running. The parts that were purchased and, installed in his vehicle were brand new parts related to the problems that he was having. Parts that were replaced consist of spark plugs, distributor cap, distributor rotor, spark plug wires, upper and lower intake gaskets and bushings for the air filter housing. This vehicle was completed within a week and test driven for roughly 10-15min with no issues of stalling out anymore.  As of completion Mr. [redacted] was called and told his car was done and that he could come pick it up.  He did not have the money as agreed upon and the vehicle sat on our lot for six months without accruing any storage fees. Many garages would have charged him 25-30$ dollars a day. With how long his vehicle was at my establishment I should have filed for a mechanics lien on the vehicle and took ownership. Trying to help Mr [redacted] out I moved the vehicle to a storage lot and continued to charge him nothing for storage. Finally after almost 6 months sometime I believe late february  Mr. [redacted] paid off the repair work and contacted me about getting his vehicle back.  At this time I told him where the vehicle was and that it was buried in snow and ice mounds at our storage lot from sitting all winter. That he would have to get it unburied but I still would not charge him storage (just happy to finally have it paid and going to be gone)  After, we explained the situation at hand to Mr. [redacted] he then a week later contacted  the police telling them we had his car and would not give it back. The police called my establishment and when they found out I did not charge him anything for almost 6 months of storage and all mr [redacted] had to do is unbury his own vehicle from the snow the cop started laughing at the situation and couldn’t believe that mr. [redacted] called the police.  Although then the cop and myself came to the conclusion to charge a small fee and unbury the car to be done with the situation.  Mr. [redacted] while picking up his vehicle went on and on with many threatening and derogatory remarks to my employees along with saying that he would kill me.   Mr. [redacted] has called several times after getting his vehicle back stating that his vehicle is not running right and threatning us.  I have told him there could be many possibilities for it not running right after letting it sit all winter. And assured him that when the work was done it took care of the issue he brought it in for and he could have came and test drove it. Trying to help each and every customer with there situation I would normally have my mechanic take a look at it and see if it could be something simple from sitting.  Although I refuse to have mr [redacted] at my facility as he still calls with threats till this day.  My technician that was performing the service to Mr. [redacted]’s vehicle has 30+ years of experience and owns and services his own personal Mercedes Benz.Best Regards, Hobbs Auto Sales And Service
