Dear Ms***:I represent Hoffman MusicI am in receipt of your letter to Hoffman Music dated June 16, regarding a complaint filed by [redacted] , which was enclosed with your letterThis letter constitutes the response of Hoffman Music to Mr [redacted] •s complaint.As Mr [redacted] admits in his complaint, he entered into an agreement with Hoffman Music pursuant to which Hoffman Music agreed to rebuild his musical instrument in order to make it saleable, and then Hoffman Music agreed sell the instrument on consignment and deduct the rebuild costs from the sale proceedsMr [redacted] admits in his complaint that Hoffman Music performed the rebuild work and that Hoffman Music sold his instrument on consignmentMr [redacted] takes issue with an accounting error whereby Hoffman Music did not deduct the cost of the rebuild from the sale proceeds but billed those costs to him separately when it was discovered by Hoffman Music that they had paid the full sale proceeds to Mr [redacted] .Mr [redacted] is legally responsible for the rebuild costs that he agreed to payHe has benefitted from the rebuild work that resulted in the sale of his instrument, which was not in a sellable condition when he contracted for the workMr [redacted] received 100% of the sale proceeds and has retained those proceeds for months, even after he was alerted by Hoffman Music about the mistake and sent an invoice for the cost of the rebuild.Mr [redacted] has been unjustly enriched by retaining the full sale proceeds and not paying fòr any cost associated with the rebuild ol' his musical instrumentMr [redacted] oftèrs no legal excuse for his refusal to pay sums he owes to Hoffman Music (and which he contractually agreed to pay), and instead he propounds that he is not required to pav fòr what he categorizes as an accounting error.It is unclear from Mr [redacted] 's complaint exactly what he is requesting for resolution of his complaint; howeverI loft-man Music is entitled under contract and by law to full payment for the rebuild costs
