[redacted] We were contacted to inspect a potential asbestos tile at [redacted] ’s home at [redacted] in Hastings MNThe adjuster took a sample of the tile and glue to Techtron in Anoka MN and the test came back positive for asbestos in the tile and glueI then hired [redacted] to tear out the tile and glue and to properly dispose of the productsAfter the tiles were removed, the product that [redacted] uses to remove the glue left a citrus odor, and the tech told the homeowner it would dissipate in a couple of days I received a call approximately days later from Ms [redacted] that the smell had not gone away and that she would like someone to come out and take a look at itI called my contact at [redacted] and he send a technician out to install a negative pressure fan to draw the air, and odor, out of the basement and to the outsideThis helped immediately and Ms [redacted] told me that things had improved greatlyAfter a few days of the fan running, we turned the fan off to see if the odor had gone away and I received another call from [redacted] about days after that and she said it was even worseBecause [redacted] does not live at the above mentioned address and her mother had taken a vacation, we had to work around ***’s schedule to get back and do another inspectionOnce there we saw that the citrus chemical used to take up the glue had wicked onto the wood paneling on the wall the separates the basement into two parts, and I called [redacted] again and made arrangements to have one of their techs come back and remove all of the paneling just to be safeThat inspection was done on a Friday afternoon and the tech was there on Tuesday morningThe next day, Wednesday, a Service Master technician went there to power wash and clean the concrete floor to make sure there was no more chemical in the concrete as wellWe then turned on the fan again and let it run for a couple of days to clear out the basement I received a call from [redacted] on that same week Sunday, saying that it still smells in the house and the odor has not gone awayBecause of her schedule, we are going back there today Friday May 19, to seal the wood studs on the wall that separates the basement so we can encapsulate the odor, replace the paneling that was taken down, and this should be the last thing that needs to be done to complete this projectThanks, Jason [redacted] Project Manager Office: ###-###-#### Direct: ###-###-#### Cell: ###-###-#### Email j [redacted] @smstp.com

I am rejecting this response because:ServiceMaster was entirely aware of the plaster dust over everything, as the technician who did the work mentioned this to one of his colleagues (as observed by my home security systemUnfortunately, the video was not archived)Even with this admission of white dust on many items in the adjacent rooms, ServiceMaster decided not to act, and instead pressured me to sign the form stating that the work had been completedYes, the ceiling and floor were repaired, but every other room was a disasterIt would appear that ServiceMaster made a deliberate effort to manipulate a homeowner who had been displaced for a month

*** *** had a leaking pipe in the ceiling of his home, so he opened up and pulled down part of the ceiling to identify where the leak was coming from. When ServiceMaster arrived on site (7/1/16) our technician made a slightly larger cut in the ceiling, squared it off and removed all of
the debrisThe ServiceMaster technician also lifted and removed part of the affected laminate floorUnder the laminate floor was a tile floor which was identified as inch by inch tiles that could potentially have asbestosThe ServiceMaster technician followed procedure and placed air movers and dehumidifier to remove the moisture from the air and affected wood framingWe notified the H/O that we could not do any mitigation to the floor tiles until they were tested for asbestosWe continued drying the structure for the next few days and monitored to make sure the wood framing was drying properlyServiceMaster technician removed the equipment on 7/12/and at this time we did not have any confirmation on what was going to happen to the floorThe H/O decided to hire his own person to remove the tiles so we could get at the wood sub-floor to dry itAs soon as the H/O called and told ServiceMaster the tiles were removed ServiceMaster returned the next day and set up equipment to dry the sub-floorAfter a couple of days the floor dried out and we could begin the repairs to the ceiling and floorThe mitigation estimate was sent to the adjuster for approval and payment, and she sent out the checks so the insured could make payment to usThe H/O signed the letter of Satisfaction that everything was completed to his satisfaction and there was no punch list to completeIf there was white dust everywhere we would have sent cleaning technicians over and cleaned everything for him, but we were never given that opportunity ServiceMaster did water mitigation work for *** *** at *** *** *** ***, Apple Valley, MN. The documentation that Mr*** signed on July 1, included the required Mechanics Lien Disclosure notifying customers that in the State of MN, a company supplying labor or materials for improvement to a property has days from the completion of the work to file a Mechanics Lien to protect our interest, if payment is not received The Last Date Worked for ServiceMaster on Mr*** was July 12, 2016. Invoice #*** was sent out Mr*** on August 9, On September 8, 2016, our account receivable person left a message with the American Family Adjuster for the status of the payment for this claim but did not receive a call back A statement showing the balance due was sent to Mr*** on September 15, and on October 15, 2016. I spoke to Mr. *** on October 21, and he confirmed that he has submitted our invoice to the insurance company but had not received payment yet. On October 25, 2016, to notify Mr*** of the pending mechanics lien date, I sent our Lien Notification that states “While we understand that you may be working with your insurance company and/or your mortgage company to receive payment for work completed by ServiceMaster on your property, to protect our interest we will start the process to file a mechanics lien by November 3, 2016” I received an email today from Mr*** stating that he has received funds from his insurance company. With this information my management team has agreed not to file a mechanics lien
