There are many factual errors and half truths in MR *.'s account, including: (1) I never used the term "settle" (2) RE> bad reputation: I told MR *that, in general, the -brand- of the bike in question was of poor quality, but that this particular model was OK (3) I never said: "We are even." Review: I purchased a bike through [redacted] for $249.00(bike)+$75.00(shipping) a total of $324.00. I paid in full to the seller Hokie Spokes with their address listed as [redacted] on the Bike Exchange website [redacted]. I contacted Hokie Spokes on Saturday, May 21, and Monday, May, 23 asking when my bike will be shipped along with tracking information. At this time I have not heard an answer. Hokie Spokes business hours are Monday through Saturday which I contact them between those days. I don't know when my bike will be shipped or any tracking information on the bike I paid for which is the Fuji Del Ray they have listed on the Bike Exchange website the AD [redacted]Desired Settlement: I will like Hokie Spokes to ship out the Fuji Del Rey bike that I paid $324.00.

Review: I purchased a used bike from Hokie Spokes on 6-28-14. When we purchased, the owner offered to put better tires on the bike, which we accepted, and this was no charge. After he put the tires on, the tire was rubbing the frame, but he said it just needed to settle in and it will be fine. The first time we rode it, the bike chain fell off during riding, and the pant guard shattered as a result, and the wheel was still rubbing. I walked the bike back to the car and took it to him. He worked on it and swapped tires back over, which we appreciated and he tuned up the wheel, brakes, etc. During this time, he told us that the bike we bought had a bad reputation, but then retracted that when I questioned why he sold it to us and recommended it. The bike was purchased for $139.00 plus tax, for a total of $146.37

The second time I rode the bike was Sunday 7-27-14 and 2.5 miles into a 5 mile trail ride, the wheel spoke busted and the wheel would not spin freely. So, I had to walk the bike back 2.5 miles in the rain. During the walk, the tire got a hole in it because I had to push the bike back 2.5 miles and it was a paved riding trail. This morning, I returned the bike to the store and am 30 days into the stores posted refund/exchange policy on their website (30 day policy). He immediately told me that since he rents bikes for $45/week and that came out to about $150 that we are even. I reminded him (and he remembered) that I wasn't renting the bike, I had purchased it from him. He told me that I have to see things from his perspective and that I wanted a $300 for $150 and that wasn't possible. I directed him to his OWN website to review his posted policy and he read it and said, "well that site is old so....." and so I asked him, "so you're not going to honor a posted policy?" and he replied, "if that's what you want to call it." Then he told me, quote, "If you're going to be an [redacted] about it then we can take this to court." I had not mentioned court or anything up to this point but was getting pretty irritated. He then pushed me to buy another bike from him instead that would be better and I was absolutely not going to do that. He told me he would not give me all of my money back and that I was being unreasonable in my request. I also took a timed screenshot of his policy as it stands today (7-28-14). He kept pushing me and pushing me and I finally put my foot down and said I wanted a refund, nothing more. He again said he would not give all of my money back and that he would only give me $56.86 and that was also taking away more money for the tire, as I guess he expected me to carry the bike 2 and a half miles. Before he would refund me, and he would not do it before I signed, he made me sign a document saying I would not take further legal actions. I did not receive a copy of this document and I LITERALLY HAD to sign before he would give me any of my rightful money back. I am not trying to take anyone to court or have legal action over the difference, but I do want this resolved as he is falsely advertising policies on his website and he is taking money from people after they purchased a bad product. He does not stand behind his products.Desired Settlement: I would like the remaining $89.51 minus the tax he paid returned to me as I returned the bike within the 30 day range with great reason as to why. I was not causing any trouble, I simply brought the bike back in and asked for a refund, nothing more. He then become very mean but tried turning everything on me as if it was all my fault for buying a cheap bike.
