As you can appreciate, we get many emails on a daily basis. Part of my job is to screen emails and ensure that [redacted], the owner, gets to all of the important ones. He answers all of these emails as soon as possible, whether it is a...

request for new work or a concern from an existing customer.
You stated that you have contacted us 3 times so far this year. Your email of July 13 was the first one that we have received, which was only one week ago. I read your email and decided it was one I should pass along to [redacted]. It is on the list I will give him this week.
In May and June of this year, we had problems receiving emails that were sent to us through our website. Although we did lose some of our emails, our website provider has resolved this issue. If you tried to contact us via our website, I do apologize if we did not get your emails. Neither [redacted] or our office received a phone call from you. When you have an issue you want resolved, it is sometimes better to make a phone call instead of relying on emails.
Your landscaping was completed almost 2 years ago and you have not complained about your grass until now. After your work was completed in 2015, you sent us an email stating that you were very happy with the work we did.
We do not provide a warranty for living products such as sods. When we install sods, bushes, trees, etc., we ensure that they are healthy while being delivered and installed. After that, we have no control over how an individual takes care of their new sods or plants. There are many reasons why grass can become unhealthy. Any or a combination of the following could be the problem: improper watering, improper mowing, infestation of insects, salt damage, pet spots, drought, fungus, improper use of fertilizer, etc.
We cannot replace your grass free of charge. The sods were installed properly. We always use 4" of topsoil under the sods unless a different amount is requested by a customer. I am sure I could provide you with receipts for topsoil that was delivered to your address. [redacted] figures out the square footage and knows how much topsoil it will take to achieve that 4". After 2 years has passed, some of that topsoil has worked its way down and that is why you do not see 4" now.

When we installed the culvert at the end of your driveway, we had to take several things into account -
the grade of the ground, your existing driveway, and the ditch. The culvert was installed properly with all of...

these issues taken into account. We can only do so much with the conditions of your existing ditch(it is not a very deep ditch)
If we were to lower the culvert like you are asking us to do, the water would not drain out of the pipe properly.

"The only resolution is to have the driveway culvert redone to the specifications from [redacted] If the company/[redacted] do not want to correct it then we want a refund for the quoted portion for the driveway repair that he quoted on his original quote. As stated in the previous response, the culvert was installed properly. If we were to lower the culvert 6 - 8" as you suggest in order to hide the sidewalls, it would be too low and would not drain properly. I took dozens of photos of other culverts (which I sent to you) All of those photos show driveway culverts installed exactly how yours was installed. [redacted] subcontracted Personal Care Landscaping to complete work at [redacted]'s residence. We were not working for [redacted]. Any damages that we caused while landscaping at this property were repaired by [redacted]. ...

They deducted the cost of these repairs from what they owed us. We did not complete any of the repairs as it was [redacted]'s responsibility not ours.
[redacted]'s claim that Personal Care Landscaping is unwilling to pay for repairs to his home is not true. I have informed him several times that it is [redacted] and not us who are responsible for any damages that were done. His demand that he wants the repairs done properly is directed to the wrong company and should be directed to [redacted].
Upon completion of the work we performed for [redacted], I was contacted by [redacted]'s wife, [redacted]. She asked me to provide a quote for additional landscaping above and beyond what we did for [redacted] Homes. I provided a quote, which [redacted] accepted. This work was completed (supply and install garden soil to create beds in the front and labour to install plants) We sent an invoice for this work on July 25 in the amount of $[redacted], which remains outstanding.
On August 5, I received an email from [redacted] apologizing for the delay and letting me know that she was sending payment that coming Monday. Three days later, I received an email from [redacted] stating that we will not get paid for this work until all damages have been repaired. I explained again that it was [redacted]'s responsibility to do any repairs. After sending [redacted] a statement on Sept. 1 of his balance owing, he once again emailed to say he was not paying this bill and added the following: "My father is a lawyer, we will see you in court if you would like. Because if you and [redacted] don't fix this stuff I will be suing both of you."
On Sept 6, [redacted] emailed to tell me that [redacted] agreed to fix any damages, but he did not want to pay the full amount of the invoice I sent him as he claimed that some of this work should have been included in the work we did for [redacted]. I explained that the work we did for [redacted], at his property, had nothing to do with the work that his wife hired us to do and that Personal Care Landscaping and [redacted] are two different companies and if they have problems with [redacted] , to deal with them and just pay us for the work we did. I told him that I thought he was just making excuses and trying to get out of paying me the money he owed me. He confirmed that with his last email to me on Sept 7 when he wrote: "Again, you want to be paid in full, I want my repairs done in full. " Or "Wave the flower bed costs, and I won't sue for damages and other issues, and we can walk away from this."
I am frustrated with the amount of time and energy I have put into fighting with [redacted] and growing tired of his threats. I want to be paid in full for the work that [redacted] hired us to do. We put in material, labour and machine work and they owe us $[redacted] + interest.

I am not being paid to give legal advice, however;
If you damage someones property, it doesn't matter who you're under contract with at the time. You are liable for damages if they're not fixed.

You were trying to double dip on this deal. You invoiced [redacted] for the work done, then you tried to cheat my wife for the same work. And now you're whining because you were caught.
I am trying to deal with this out of court, however [redacted] doesn't seem to be able to comprehend this.

[redacted], As stated in my previous response, we were hired as a subcontractor by [redacted] to complete landscaping work at your property. We sent our invoice to [redacted] for payment. We did not bill you for any of this work. [redacted] was responsible to repair any damages caused during the landscaping work. The damages were repaired by [redacted], not us. In turn, [redacted] deducted the amount for those repairs from our payment. If you have a problem with how these damages were repaired, please contact [redacted]. This has nothing further to do with me or my company.
After we completed the work that [redacted] hired us to do, your wife asked me to come to your residence to provide a quote for additional work for garden beds (above and beyond the work we did for [redacted]) [redacted] knows that she agreed to have this work completed for the price quoted. I trusted her to pay for the work once completed. We sent [redacted] an invoice for this work on July 25 and it remains unpaid. My company has paid for the material and labour to have this work completed, and I want to be paid.
Although it is not your business, I will send you a copy of the invoices I sent to [redacted] to complete landscaping work at your property. This will prove to you that I did not bill for this garden bed work twice. I will also send you a copy of the Quote that [redacted] received and agreed on.
It is very unfair that you are trying to get away without paying for this work.
