Revdex.com:I have reviewed the response made by the First Republic Bank (FRB) in reference to complaint ID [redacted] and find that this resolution is satisfactory to me However to clarify, the complaint was not due to a delay in the refund as the FRB's response/apology makes it sound It was about the FRB's refusal that there was an over payment and insistence that the FRB's calculations were right The refund checks were not sent by the FRB as stated but by the title companySince our agreement was with the FRB and the payments were made directly to the FRB the refund checks should have come from the FRBTo save everyone's time we will not dwell on this or the interest issue, initially raised in our complaint We filed this complaint only after the FRB stopped answering our emails Similarly we still do not have an answer to our question about possible annual fees on the HELOC loan which initially was advertised as "no fee"We hope it will not come to another complaint before these possible annual fees are officially waived We hope as well that we can have good business relations with the FRB Sincerely, [redacted]

First Republic Bank (“Bank”) appreciates the opportunity to respond to the concerns of one of our clients (“Client”) in regard to their recent mortgage refinance and home equity line of credit (HELOC) transactions
According to the Bank’s records, the Client contacted the Bank in March in
order to refinance his existing home mortgage with the Bank and to also obtain a HELOC on the property. Both the refinance and HELOC, account numbers *** *** ***, respectively, closed on June 1. All documents were sent to Nassau County (“County”) for recording, and the refinance was funded on June
After an investigation, involving the Bank, title company and law firm that handled the closing on the Bank’s behalf, it was discovered that several factors contributed to this unfortunate occurrence. First, due to the simultaneous closings of both the refinance and HELOC transactions, recording and title fees assessed on the loans were inadvertently co-mingled. This resulted in the client being assessed fees on both transactions when, in fact, the Bank had agreed to pay all fees on the HELOC
Furthermore, several of the recording taxes and fees disclosed to the Client were based on estimates provided by the County. It is a common practice for the County to provide estimates for these transactions and to then adjust the fee upon actual recording and provide a refund for any overage paid. In this instance, fees assessed for several mortgage taxes, affidavits and the Consolidation, Extension and Modification agreement (CEMA) exceeded actual costs; however, a refund could not be provided to the Client until the County calculated the true cost and provided that information to the Bank
After identifying these items and carefully reviewing all other fees assessed to the Client, it was determined that the Client had over paid recording fees with the County by $90. Combined with the fees paid for the HELOC, the total was $1355.07. The Bank has sent check number 1320419654, directly to the Client via courier, in that amount. We have verified that the Client received this refund on July 21. Additionally, we subsequently identified that the initial check we sent to the client was insufficient, and a supplementary check has been drafted in the amount of $47.43, in order fully refund the Client for overpayment on the HELOC. This check has been sent directly to the Client, and they should receive on July 28. The Bank has also reissued a corrected Title Charges form, along with County sales tax invoices for the refinance; all of which will be sent directly to the Client’s address on file
