I cosigned for a loan, the primary borrower filled bankruptcy on the loan, now the Credit Union is posting that I am not making the payment When the credit union contacted me that a payment was late I paid the payment. Then the credit union sent my money back and posted that I did not make the payment and continues to post that I am not paying. I as them if I could pay it and they said no. If I can not pay it then how can they hold me responsibe for being late. I did not hire an attorney the primary did. I would gladly pay the loan off but they will not let me and they are ruining my credit rating that shows I pay my bills on time and intend to continue doing so. Why will they not work with me to keep from ruining my credit? The posted non payments should be taken off my credit report and they shold allow me to pay what ever they see fit to conclude the loan obligation.Desired SettlementTake the missed payments off my credit report and allow me to pay the payments that they would not allow me to pay on time. I am trying to work with them but they have made it impossible for me to pay and penalizing me for missing payments covered in the primary borrowers bankruptcy. Business' Initial Response We agree that [redacted] did cosign a loan. The borrower has filed a Chapter 13. In filing bankruptcy this places an automatic stay on this loan. Therefore we are unable to collect from the borrower or **. [redacted] due to the bankruptcy. The borrowers attorney requested we return the paymant to **. [redacted] because of the bankruptcy. We did return the money to him due to bankruptcy laws. As long as the loan is in bankruptcy we are unable to accept direct payment from the borrower or co-borrower.Consumer's Final Response (The consumer indicated he/she DID NOT accept the response from the business.)Holly Credit union continues to post missed payments. I have missed no payments it is in bankruptcy, not In default! I did not request a refund, but I did make the payment that was posted no paid? I did not file bankruptcy or hire the attorney mentioned. I did hire my own lawyers and they will be working on resolving this injustice.
