Dear ***,
We were informed
this morning regarding a complaint filed against the TD
Convention Center (complaint ID ***).
The customer’s desired settlement to be allowed as a vendor in the
Holiday Fair show is no longer possible.
In addition, the disputed amount of the booth rental is $instead
of the $listed in the complaint.
Furthermore, the customer’s position that door prizes were a factor in
the decision is not accurate as any exhibitor’s decision to offer door prizes
is entirely voluntary on the part of the exhibitor and has no bearing on the
booth rental reservation process.
The customer (“Exhibitor”)
participated in the Holiday Fair for the first time last winter and
expressed an interest in participating again in the Holiday Fair show. The Exhibitor filled out an application on
December 6, to participate in the Holiday Fair but failed to make the
required 50% deposit at that time. Note
that the Exhibitor’s application requested a $corner booth which was an
upgrade from their previous booth. If
exhibitors who participated in the show wished to request the same booth
or a different booth, they would need to complete an application and make a deposit
to reserve the booth by June 1, 2015.
Applications/deposits received after June 1, would have booths
assigned on a first come, first serve basis.
As of June 1, 2015, the Exhibitor failed to make any deposit for the
application that was submitted on December 6, 2014. Note that the Exhibitor had from December 6,
to June 1, to secure their place in the show by making a deposit
The Exhibitor’s corporate
office/supplier has mandated that the TD Convention Center only allow one
exhibitor in the show who sell their products.
The TD Convention has a waiting list of other exhibitors who sell the
same product as the Exhibitor. Once the
Exhibitor (who up to June 1, had seniority over the other waiting list
exhibitors) failed to make a deposit by the deadline, the TD Convention Center
moved on to the next exhibitor on the waiting list. The Exhibitor did inform the TD Convention
Center that they were going to make a payment before the deadline, but no
payment was ever received. The Exhibitor
paid for last year’s booth rental via credit card and could have easily
contacted the TD Convention Center to pay the deposit via credit card to avoid
missing the deadline for this year’s show.
Due to the Exhibitor’s failure
to pay the required deposit, as is clearly stated on the application, and the
Exhibitor’s corporate/supplier’s stipulation limiting the number of exhibitors
selling their product, the TD Convention Center has moved on to another
exhibitor on the waiting list which precludes this Exhibitor’s participation in
the Holiday Fair show

In early May Mrs[redacted] was informed that corner is not available and she decided that other booth is acceptable and to secure this space the down was due by June 1st 2015. She stated in a email that she will sent check signature required on delivery. and on May 30th she sent email asked if received and we responded no not yet. She should have followed up with the post-office on location of her check. We are not responsibly of tracking a payment. Mrs. [redacted] wanted to pay by credit card on June 2nd but by our application/contract down payment is required by June 1st .

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint. 
An option to pay by credit card was not offered as an option throughout our many discussions via phone or email. Clearly [redacted] has someone else in mind for this booth.
