Review: We signed a contract in March for our home to be closed on June 4, 2014. This did not happen. He then promised us it would be mid July 2014. Again did not happen. We told him it needed to be done by mid August as my daughter needed to be enrolled in school. He promised beginning of August, then August 22 then August 29. None of these dates happened. He then promised mid September and then end of September. Again didnt happen. The next promise was mid October. Didnt happen. We are still not in our home nor does he have a new closing date for us. He tells us things are going to happen and when we drive out to look it has not happened. He tells us workers will be there and then they're not. Twice the past month alone there have been no workers at all for the entire day..one because of it drizzling in the morning (they work indoors) and the other because halloween is a "holiday". I go by every morning at 930 and there are no workers. I go back at 5 on Mondays and there are no workers. The days they do show up it is only half a day of work and then they are gone. This builder has done nothing but lie to us, our bank, our realtor and our lawyer since March 2014. He is told time and time again things need to get done as we are under time restraints and he does not care. He rarely returns phone calls and emails. He sends me straight to voicemail everytime I call him with no calls back.Desired Settlement: We want the house closed on next week and we want to be moved on Nov 15. I want to be refunded all the out of pocket money we have had to spend in transporting my daughter to school out of district and to various other activities in that district. We want our rent refunded that we have been forced to continue paying. We want money we had to spend for events that were planned for the house that now had to be outsourced to other locations. These expenses all incurred because he did not keep up his end of the contract of June 4 and now 7 months later still has not finished the job.

Review: My husband and I went into an agreement with Home Mark Homes ([redacted] to build a modular house in [redacted] This would be our first home and we had only $50,000. [redacted] gave us financing to buy the land and for a rebuild only. Home Mark offered to buy the land with us (60,000) we paid 30,000 and then get us separate new construction mortgage with "their" finance guy. After the closing we were told we now had sign the entire property over to [redacted] so he could obtain a 60,000 bank loan that we would now have to make payments on. We also had to pay second set of closing fees for this!! We were lead to believe that it was his money invested that he would get back at the final sale. Now missing half our deposit after the land purchase we were forced to agree . Home Mark now left everything up to us, we then had to obtain every permit ourselves, hire a variance attorney, pay the taxes and gave us zero help. [redacted] said his engineer would handle the CAFRA permit which was needed for the property, we had to pay him and keep after him to get done. His engineer's application failed miserably and forced us to hire a professional company at great expense to finish the job. [redacted] didn't even tell us to cap the water and sewer lines so we paid fees for close to a year before realizing we could cap them off. Then the finance guy they set us up with left the state with 1,500 dollars of our money and never submitted any application for our mortgage that we led to believe had been approved. After paying the 8,000 to demo the abandon house on the lot all that was needed was to adjust the house plans to reflect the new hurricane sandy rules in place to get the building permit. We never got those. $86,000 later we have with a shattered dream of homeowner ship. We have told [redacted] build what you want sell the house and give us our money back. He agreed. My husband calls him weekly his last promise was this spring. June 5th, 2014 and we are still homelessDesired Settlement: I would like my investment back before this matter ends up in court. If it ends up in court I will be demanding much more for damages for all the pain and suffering we have endured.

Review: We contracted with Home Mark Homes to build us a new house on 4/19/2011. The house is a modular construction, and the modules were set on 5/2/2012 one of two houses set that date. As of 2/24/2014, our house is still not completed. Home Mark Homes refused all requests to provide an estimate for the Certificate of Occupancy. In addition, there have been design issues with the house. We made all of our payments and have been patient, but we are losing money with every month. The progress has been disjointed at best. It took them a year to put on the siding during which time the interior of the house was subject to water damage especially on the stairwells resulting in mold and rotting of the flooring. Drywall & insulation were removed and have not been replaced. Water damage was to the point that Home Mark Homes delivered a new set of stairs to the house in Sept. 2013. Those new stairs remain uninstalled and are still sitting on the ground as delivered in Sept. of 2013. Ceiling fans were delivered as requested by Home Mark Homes in July 2013. Those fans remain uninstalled and in the possession of Home Mark Homes. Home Mark Homes has gone through four different cabinet suppliers: the last one was communicated to us in October 2013. Cabinets remain undelivered onsite for installation. A furnace was delivered on site on 16 Jan 2014 and installation remains incomplete. As of this writing, the house remains in an unfinished and unsecured condition. Windows and doors have been found left open. The two outside stairs and decks were started in September of 2013 and just as quickly stopped. The materials for these two projects have been left outside since Sept 2013. The outdoors decks were also to have been made of composite decking as advertised has been instead constructed of plywood covered in fiberglass. A window and ceiling beam cracked since the modules were set still are not fixed. We have reported all defects to Home Mark Homes per our contract.Desired Settlement: Before we have to resort to litigation, we would like Home Mark Homes to issue a date for the Certificate of Occupancy/completion of project and handover to us. Home Mark Homes states in our contract that "Complete Work: Within approximately four months of the modular home set on it's foundation." With this statement, we would like Home Mark Homes to commit to a finish date in April 2014.
