Response:The complainant in this issue states that, in addition to loud music and noise, the offending tenant has put garbage on his patio and is smoking marijuana on the premisesYet, he offers no proof that those items were perpetrated by the offender in questionWe are aware of the complainant's calls to the policeYet, the police have issued no citation for noise or any other offenseThe police that went on these calls found no reason to issue a citationand were allowed entry into the offender's apartmentOf the tenants in the building, only the complainant has complainedWhen asked, neither of the other tenants voiced a complaint.The complaining tenant was offered the opportunity to vacate his apartment with no penalty, even though he has not fulfilled the term of his lease.He refused, arguing that the other tenant be forced to moveAt this time, we have no legal grounds for forcing the offending tenant to vacate the apartmentWe made the same offer to the offending tenant--to vacate with no penalty-- and this tenant also declinedIt is our opinion that the complaining tenant would rather complain than resolve

The police that went on these calls found no reason to issue a citation. and were allowed entry into the offender's apartment. Of the 4 tenants in the building, only the complainant has complained. When asked, neither of the other 2 tenants voiced a complaint.The complaining tenant was offered the opportunity to vacate his apartment with no penalty, even though he has not fulfilled the term of his lease.He refused, arguing that the other tenant be forced to move. At this time, we have no legal grounds for forcing the offending tenant to vacate the apartment. We made the same offer to the offending tenant--to vacate with no penalty-- and this tenant also declined. It is our opinion that the complaining tenant would rather complain than resolve.
