*** & ***- I am again sorry that things have come to this However, as I have explained repeatedly to the two of you, giving you access to the garage is not something I have authority to do As I have repeatedly stated, I am continuing to work with the owner’s of this property towards a solution to this problem you have, but at this time they are unwilling to grant access to the garage. There is nothing I can do to change that. As you stated, it is accurate that I have been working on this issue since September. I’ve been working with the owners of the property to find out what is needed to repair the garage and get it where they feel comfortable letting the residents use it. They have offered to make those repairs if the tenants would like to increase their rent by $per month for the remainder of the lease term. However, without an increase in rent they are unable to make those repairs right now and therefore cannot allow access to the garage. I’m also sorry for any belief you may have regarding lack of communication or miscommunication during the showings of this property. I again want to reiterate that at no time did our leasing agent, *** state you’d have access to the garage. In fact he clearly remembers stating that at the time of showing, then again at time of walkthroughs stating the garage was currently unavailable. He made these same statements to at least other people who looked at the house during the marketing periodAt no time would he have said he did not have keys (this part is true) but would give them to you at mo(this part is false). This is very clear as his showings instructions clearly state the garage was not in structurally sound condition and so for safety reasons keys / access would not be provided. I’m sorry you remember otherwise, but that is not the case. With regards to your request for monetary compensation, I am willing to give you a $one time rent credit towards February rent or outstanding balances. We however cannot offer any ongoing rent deduction for the remainder of the lease. The vast majority of houses in this area offer either car or no garage space at all. Often with garages that are unable to accommodate cars at allIt is something that people who live in Waldo understand and expect. Most people living in Waldo understand that parking on the street or in driveways is standard for the area I again want to make it very clear one more time that I have been working to get resolution to this problem for you. However, as stated in multiple emails to you two, I do not own the property and I do not have authority to grant you access. I completely understand your frustrations and as a small token I am offering the one time $credit, I just do not have the power to do anything more than that Thank you for your time, we do appreciate you as tenants and we are sorry this has come to this point *** Tell us why here

*** Property Management leased the property on *** *** to the two tenants. However, it appears
that there is a misunderstanding on their part regarding the garage The garage is detached from the house and is suffering from some structural issues along with roof issues that makes it potentially unsafe for use. Due to these issues, at no time was the garage advertised as part of the property that a tenant would be able to use during the lease. Our leasing agent made reference to the lack of access to the garage during all showings of the property to make this clear to any perspective tenant At mohe again reminded Ms*** and Ms*** that access to it was restricted. At that time he did note that the owners were looking at possible repairs to the structure of the garage at some point in the future, as this is what we were told by the owners ourselves. However, no particular time frame was guaranteed. The tenants started asking about the garage immediately after moand again we reminded them that access was restricted at this time, but that we would be working with the owners to have them look into repairs At one point it was discussed with the tenants regarding a waiver of liability and having the tenants sign this to gain access to the garage. The owner was contemplating this after much encouragement from our company. However, ultimately the owner has decided they do not want the liability or responsibility of giving access to the tenants for the garage. We have been pushing the owners for month’s to figure out their plan, but ultimately we are unable to make decisions or have work done without owner approval. So that decision falls to the owners discretion and not something we are authorized to make. We have been in communication with the tenants through this. Much of the delays come from our inability to get an answer from the owner. But as soon as we had additional information we were providing updates to the tenants. This is an unfortunate situation for the tenants, but it is one where in their own words “signed the lease with this assumption in mind.” That assumption being access to the garage. Even though we noted it at showings, they seemed to assume they could use the garage. As unfortunate as it is, this is a simple misunderstanding on their part, not something worth filing a complaint over. Thank you, *** ***

I am rejecting this response because:  The allegation [redacted] is making that myself and my roommate [redacted] were informed at showings before signing our lease that the garage would not be accessible and not included within our lease is completely false. This was in no way shape or form a misunderstanding on our part. If we had been told this prior to signing the lease then why would there be any more need for communication on the issue or a need for [redacted] to try to fix the garage? I reported this issue to the Revdex.com because I do believe this was a case of false advertising. It was never mention to myself or my roommate [redacted] during the initial showing of the home that the garage would not be accessible. [redacted] is [redacted]s associate he is the one who did the showing of the home he informed us that he did not currently have keys to the garage at that time but he did say we would have access upon move in. If indeed it was revealed to us in showings that access to the garage would not be possible this should have been clearly stated and noted within our lease and our lease makes no mention of the garage.  Below I have attached email correspondence from the business in these emails it states on 10/24/16 that [redacted] was working to resolve the issue with the garage. So why would [redacted] state this if from the beginning before signing our lease we were informed that we would not have access to the garage and it was not being advertised? Myself and my roommate are requesting $100.00 dollars be taken off of our rent as this is how much it would cost us to rent a garage to house our vehicles.
