I hired Home RX LLC to make the following repairs at my house.

1. Attic Support Repair 2. Soffit Repair 3.Fascia trim

This work was scheduled to start on August 10 2020. I paid the initial deposit of $1,100 and the remaining $1,100 was due upon completion of work. We didn't sign a contract like the other two occasions I hired the company. I only have an estimate for the job. On August 10 2020 the contractor arrived without any knowledge of how to cut and install fascia. Home RX essentially bid for the roof work, but did not have qualified personnel to complete the work. They also arrived without proper gear (ladder which we had to borrow from a neighbor), and treated the materials with such poor workmanship. On August 11th 2020 the contractor finished the job and left the property, that same day I received an invoice for the outstanding balance, which I paid in good faith promptly. On August 12th 2020 I went to the property with my partner to inspect the work and that’s when we noticed all the mistakes on the Fascia. That same day, I spoke with the president of the company Mark ***, fixes needed to be made. Mark asked for pictures and said that if there were mistakes made by the company, Home RX will fix it. On August 14th 2020 I sent all the pictures. On August 17th 2020 the president, called me to say that I needed to pay for the material in order for his company to fix all the mistakes. To this I vehemently decline. Mark retracted his initial offer and said that he is not going to fix the work because "I accepted" the work when I paid in full. In the two previous jobs done by Home RX, if any mistakes were done, the company came back to fix them even though I had already paid the total balance of the work. It wasn't my knowledge that for this new project if I paid the outstanding balance, no other work or corrections could be performed unlike previous instances. Looking back, Home RX has consistently underperformed in their quality of work.

Tell us why To whomever this may concern.As stated to Mrs. ***, she keeps mentioning that my guys went without the proper gear now in writing she is saying that just like she was telling me over the phone that she had to even show my employees on youtube how to do the job, I've already told her professionally if my employees was that bad just like my attorney told me why would she not stop the job then and there and call the business owner which is me and let me know what was going on then and there? so that I could of rectify the situation then and there, she didn't give me that opportunity to rectify it then and there as the homeowner of her property like she stated that she is, she should've stopped the job then and there but she didn't, she allowed workers that did not know what they were doing to proceed with the job and even complete the job. My attorney advised me that I didn't have to take any further actions, she keeps mentioning that my guys didn't know how and what to do so she keeps saying it's not her fault but it is, I unfortunately could not be there that day because I had multiple jobs and I would have never thought that my guys would lie to me and tell me they knew how to do something that they didn't and if I was on site and I would have seen that they didn't know how to do it I would have stopped the work myself, my attorney is aware of the whole situation and another question that popped up from my attorney and myself is, if I went out to the property that same day and she took the time to ask me advised on her dishwasher and why wasn't working? and I actually figured out the problem for her that has nothing to do with the current project that I was there in the first place, anyhow if I went out to the property that day that the project was being completed why wouldn't she have brought it up to me in person when I was there?, now I was telling Mrs. Keishla that my employee told me that he had proof that multiple times he asked her if the job was good to her standards? and she told him ''Yes'' multiple times, now over the phone she told me -''stop acting like you heard the recording when you didn't!'' - and at that time I didn't, and as I stated to Mrs. Keishla my employee Jose came personally to my residence because the recording is about 12 to 15 minutes long and there's no way that he could of emailed it or texted to me since the file was to big to send, my employee got so upset that I wasn't believing him that he brought the recording to my residence which I had it uploaded to a USB drive that is now in the possession of my attorney just in case the situation escalated more, now I personally can say I heard her telling my guy that the job was good multiple times throughout that 12 to 15 minutes recording, that it looked amazing and that we were good to go and in that recording you can hear my guy stating "Are you sure? so we don't have to come back and if anything is wrong let us know now so that we can fix it now" and she said multiple times as well "Yes, it looks amazing" Now Mrs. keeps stating and stating that my guys didn't have any knowledge of the job and they didn't have the proper equipment and this is something that my attorney and I keep mentioning why wouldn't she stop the job then and there, and called the owner of the business which is myself and tell me ''Hey Mark this is what's going on''? so that I could've rectify the situation and send a new crew out there, but no she let the job keep going without telling me anything and even after that the same day I went in person while the job was being completed that day, we engaged in conversations, she asked me on adviced on some other equipment that had nothing to do with that job and still didn't mentioned anything, and then after that told my guys multiple times once the job was completed that day that we were good to go, my guys called me that same day before leaving and told me ''Mr., Mrs. has already told us multiple times we are good to go in the job and is completed perfectly to her standards, can we now leave the premises?'' and I said ''Yes as long as she approved the job'' and he stated '' Yes and we have proof of it'' and I told him '' Yes you may leave then", so why would she allowed guys that supposedly don't know what they are doing as she stated to complete the whole entire job? when she said it herself in the first 10 minutes that they started the job that they didn't have the equipment, that she was showing them on youtube, so why would she let them proceed and complete the whole entire job and not tell me that she didn't like the job until 3 days after the project was completed and I was paid for, also why would somebody pay a company for a service that they didn't like?, I know any person with commonsense if they gave me 50% deposit and they know that they need to pay for the 50% once the job is completed I wouldn't pay that remaining final 50% until I'm satisfied with the finish product. We've done two other major projects for Mrs. and it states in our contract prior that she signed ''Once paid for the completion product that's your final agreement that you are satisfied with the final product and you are clearing us for any liability''. Now I understand that we didn't have a contract for this project but if I had sent two prior contracts that are exactly the same to her and she signed it she already knew how we worked so she did in fact know that once yo\u pay for the job you are agreeing to the work. If she would like a copy of this recording in a USB I would need her lawyer to contact my lawyer so that he can give him a copy of it. Also she keeps stating she didn't know that by paying me she was agreeing to the work well is like my business attorney said this isn't the first time we've done business together so this isn't the first time that I sent her a contract, there is three paragraphs on that contract that states " Client will not pay the contractor Home Rx, LLC till the client is satisfy with the work, once client pays the contractor the client is accepting the work of the contractor'', she also has it in black and white we both signed it.Like my attorney said if she did not read the contract carefully that is not my fault, I don't like being lied to and I feel really disrespected at this moment because I caught her in multiple lies and can prove it on paper and now audio, my attorney told me I didn't have to do nothing else and cease all contact with her all unless I heard of an attorney, and yet I still called her with respect and told her that I was willing to go half and half with her, just because my employee lied to me about knowing how to do that specific job but now that I found out that she in fact did agree with the work and lied to me I'm not agreeing to anything anymore.If she feels that my business is still in the wrong she can go ahead and take legal actions and have me served and my attorney will take it from there. - I went ahead and attached the date that she paid me the final 50% and the date that she sent me the pictures, what I don't understand is why didn't she let my guys proceed if she says they didn't know what they were doing?, Number 2. Why would she not tell me that same day I went in person while they were still working at her property? Number 3. Why would she paid me the remaining 50% if she was not satisfy with the work, knowing that our prior contract states that once she pays she's agreeing with the final product and most importantly if the job was so important to her, why did it take her 3 days to let me know and 3 days to send me the pictures?, on this images you can clearly see the dates. As mentioned I'm not going back to the clients house to fix anything and is she still feels like I owe her anything she can go ahead and have me served.

I am rejecting this response because:

I had done 2 previous jobs with this company, we accepted the work and paid in full. Days after paying in full we found mistakes and still Home RX came back to the property to fix things. He never said "we have a contract that you signed and you agreed to only paying when you were satisfied". Mark always told me "no matter if you paid me, if my company did something wrong we are coming back to fix it". And they did in two previous occasions.

With this new project we also supposedly "accepted" the worked when we paid in full. The next day, on August 12,2020 after better examination of the work, we noticed all the mistakes and contacted Mark the same day. Not 3 days later like Mark is claiming. We notified and talked about what needed to be fixed with Mark. We sent him the pictures two days later when we where able to go back to the property because we live in Grand Prairie and not Cleburne.

He is now applying a policy of a contract that we don't have, and also applying it 3 jobs later.

I didn't stop the work because after I explained to the worker how to do it, he was doing an ok job. The corners of the house was something that he wasn't able to do. We want the corners and the proper fascia trim replaced that he didn't put in one location. I am not asking for the entire project to be redone. When Mark came to the property I didn't feel the need to complain about me having to teach them how to do the work. As I mentioned before, they were doing slightly better. When Mark left the property the worker was still working so there was no need to talk about what needed to be fixed yet. I spoke to Mark the next day (August 12, 2020) after we saw all the mistakes.

I really don't understand how a company will be happy with the finished product and tell the client that they are not providing any services to fix it.
