RE: Complaint - ID [redacted] We are responding per your request to the above referenced complaintAs previously stated the contract warranty period has expiredThe last email we had on this subject was back in November ofwhen we put the client in touch with a local contractor, per their request, in order for that contractor to do the patio work for themWe did not install new patios in the original contract, the patios were already there and they were told that they needed to be replaced, but they did not have us do that workWe had completed the work we contracted by and had some punch list items that took awhile to complete, due to weather and scheduling, but that was ultimately completed by We are not responsible for the patio replacements, we only had a small section of removal and replacement for the installation of the piers on the house and as stated previously the steel piers are the only warranty that is left on their projectWe understand that the client feels that we are responsible for this work; however, this is why we had a contract that states what we are responsible for and for how longIf the work is not under warranty any longer, we are not obligated to repair outside the scope of what is listed in the contract, for that warranty periodAs customers ourselves we have had warranty issues and have had the purchased item break down just as the warranty expires, it is frustrating; however, again this warranty has been expired and never covered items that we did not installWe hope this closes this matter so that we do not waste any more of your valuable time.Sincerely, [redacted] Vice President

*** *** response seems to indicate a belief that Xpert Foundations did not alter either patio during the repair This is incorrect Both patios were removed and replaced by Xpert Foundations I have attached all contracts and addendum's On page (noted as Exhibit A) of the attached pdf, you will clearly see Xpert Foundations agreed to (6/12/Change Order) - "removed slate in back area", - ex[cavate] down to create a drain system for the back wall (slate section), - relay removed slate with a positive grade - in paver section install a grate drain and and exit line - seal new layed slate with a penetrating sealer." On page 11, dated 3/28/12, item tells us "some piers will require excavation on the outside and removal of pavers and concrete [slate patio] - relay pavers w/ proper grade." More information on the slate removal and replacement can be seen on page 13, titled change order dated 8/27/ I am happy to provide photos of the patios as they exist now to show the degradation of the slate, major settling in both the paver and slate patio and proof that a positive grade no longer exists All theses items were discussed in the multiple emails provided in my last message Many other conversations were had via text message, however I no longer have the phone and can no longer retrieve the messages Finally, MrSanchez agreed verbally on multiple occasions to fix the patios We could never get him to follow through, which is why we filed this complaint

For your reference, details of the offer I reviewed appear below.The statement MrSanchez makes that he only altered the patio in front of the french/sliding doors is incorrect I have included photos that clearly show new (lesser quality) slate placed all over the patio during the work done by Xpert Foundation As the contract states on page of the pdf I provided previously, Expert Foundation agreed to remove the patio, excavate down to create a drain system, install stone, install 4" drain line, backfill with two types of stone, and finally relay slate with a positive grade This was done, the photos show many places on the slate patio outside the area that MrSanchez describes that were altered As for the lower patio, MrSanchez was aware, as he stated in his response, the purpose of the patio was to have a hot tub In the same statement he admits the work he did could not support a hot tub, so why on earth would we pay him thousands of dollars to lay a patio we can't use? The grade was always extreme, but now there are dips and low spots next to the house and it is entirely useless.Either MrSanchez did the job which he claims he did and, in effect, lied about relaying the patio as we agreed in the contract or he did relay the entire patio as the pictures and additional drains clearly show but did it very poorly Either way, we paid for the patio to be relayed with a positive grade away from the house That is not the case This was pointed out to MrSanchez in an email previously provided (on page of the Xpert Foundation Luis Sanchez Emails.pdf) dated Friday, April 19, In that same email we reported cracks in the patio grout This was well within the warranty period MrSanchez brought a mason to our home to fix everything last fall Evidence of this is on page of the emails He tells us he has approved the work that *** will do to repair the soapstone (mistake, it was slate) patio He says nothing of only removing the slate and concrete He pretty much says *** will fix the problem and if there is anything else we want done, we can deal directly with *** Xpert Foundations needs to remove both patios and properly install both with positive grades away from our home That's what they agreed to do in the contract Problems with their job were reported within the warranty period but never fixed nearly five years later I do not doubt MrSanchez's honor, but I have no confidence in his memory or his record keeping I have provided the information supporting my claims but none of the messages from Xpert Foundations address the specific problems with their work Regards,

As I explained, the existing slab under the slate stone is causing the main issue that the client is having with their upper patio. This slab was not installed or replaced by our company. The problem lies in the settlement of that slab mainly due to age, rain, and soft soils that are underneath the slab. The clients want the slate stone replaced completely and a premium stone put back along with a new slab. The only thing I agreed to do for the client was a 6-foot section in front of the French doors in the slate area. I did not ever agree to the complete removal of all of the slate, or a premium slate replacement, nor did I agree to the complete replacement of the slab.The brick pavers on the lower section are set in sand and need a slab poured under them, because the pavers are deteriorated from age they need to be replaced as well, especially since the clients are going to put a hot tub on top of them. This we did not agree to do.I had offered to demolish the upper area slate and slab underneath, plus the removal of the lower pavers and haul away the debris; this would have reduced the cost to the clients and helped the other contractor who will be working with them. That is all I volunteered to do for the client and the offer is still good, if they want us to assist them with that portion of the project.Sincerely,Luis Sanchez,Senior Certified Contractor

We are responding per your request to the above referenced complaint. We worked for the client and completed the project by September of 2012. The warranty period was for one year from the date of completion. According to the contract dated 3/6/2012 on page seven (7) the only items covered...

over a one-year period are the steel piers or carbon fiber products. We ask that this complaint be dismissed due to the expired warranty period. Thank you for your kind attention in this matter.Sincerely[redacted]Vice President

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
I have two additional emails that I was not able to upload but would like to provide.  We began raising concerns about these issues in an email dated 10/02/2012 (File attached Xpert Foundation Luis Sanchez 04162016 email) well within the warranty period.  We are still arguing these same points.  Again, I have two additional emails that show our conversation with Luis Sanchez of Xpert Foundations all the way through 11/14/2016.  Throughout all those emails, Luis never says anything about the warranty, never denies the poor quality of the patio surfaces and up until he began ignoring our emails, calls and text messages this spring, was planning to repair the patio.  See Xpert Foundation Luis Sanchez 11142016 email, where Luis agrees to do the work saying "I have given [redacted] [the mason] the go ahead on the soap stone [actually slate] repair.  He is gonna deal directly with you on the other work you want done."  Luis was at our home with [redacted] (the mason), myself and my wife when he agreed the upper slate patio would need to be removed and redone to establish the proper grade for water to run away from the house. The first time Luis ever used the word warranty was in reference to the paver patio in November of 2016.  [redacted] statements are incorrect and do not represent anything we were told by the only representative of Xpert Foundations we ever dealt with.  Again, I wish to upload the two additional emails.  I have many more.  Respectfully, I believe [redacted] statement that a 12 month warranty was in effect does not reflect the reality of the situation or the facts that can be easily verified.  We only filed the complaint when, after 4.5 years of attempting to reach resolution with Luis, the work still was incomplete.  Xpert Foundations, through its representative, Luis Sanchez never disputed our points until November of 2016.
