Initial Consumer Rebuttal /* (3000, 13, 2015/08/07) */
(The consumer indicated he/she DID NOT accept the response from the business.)
In Mr. Paul [redacted]'s response to my complaint, he states he replaced the rotted posts with new wood. He did not. I attached pictures to my original complaint that show the posts when Mr. [redacted] was finished with them. They clearly show the rotting wood covered with new paint. He looked "like a deer in the headlights" when my wife showed him what she'd found. She immediately went inside to call me at work. Upon her return, she said he was packed up and getting ready to leave. She asked him, "what about the posts?" He said he was going to cut new ones at his shop and if she'd just give him the paint again, he'd paint them too. She said, "no that's ok, I'll just paint them myself. Just bring the new posts." We never saw him again after that.
Any work not discussed in/written in the original contract was not authorized and if there were additional costs, they were never approved by my wife or I before the work was done. Mr. [redacted] received payment for everything that was stated in the contract. He accepted two payments, both of which he acknowledged in his own writing on the original contract - signed and dated.
In regard to the painting, my wife was in the process of painting the railings on our porch and Mr. [redacted] said if we wanted to give him the paint, he would paint the posts at his shop - no extra charge. He wrote it in himself on the original contract, a copy of which I submitted with my original complaint. I believe he was happy to do it so he could "disguise" the the original rotting wood.
The stone facing was not cracked prior to Mr. [redacted] starting the job. He damaged it when he pulled the sides of the steps off.
My wife and I feel taken advantage of and that Mr. [redacted] has failed to honor his word.
