I was looking for a rental home for my son and myself. I found a house and Nicole C showed me the home. When showing the house the lights were not on and we walked through the house with our cell phones. The house still had previous tenants belongings still in the home and the bathroom tub was peeling up and needed to be refinished. She told me they were unwilling to fix the tub and she was lowering the rent because of it and lowered the security deposit. She told me that the house would be move in ready before I gave her first and last months rent. I saw the house on the 25th of October and signed the lease on the 30th but the landlord was not there and did not sign. I told her I would be moving in November 13th and giving her first and last months rent on November 12th to get the keys. Nicole C told me they would be doing a Lead Paint test and the house would be move in ready. On November 6th I went back to the property and nothing was done. Previous tenants belongings were still there. The house was not cleaned. The lead based paint test had not been done. There was speckling that still hadn’t been completed either. I called Nicole C and she told me that the house was as is and she was not going to fix anything. This was not on the lease or what she had told me originally. I asked for my security deposit back of 1000.00. Nicole C refused to give me my security deposit back and then said it was non refundable. After that she agreed she would only give me half of my security deposit even though she did not hold up her end of the contract.
Hi ***, this is Stephanie Z, I am the broker of Nicole C regarding the complaint we received. I spoke to Nicole C, and here is her side of the story. The house was previously owner occupied, all personal belonging were removed and the house is in broom clean condition when they were at the house. Nicole told *** that owner will not do any cosmetic work for the property, but will repair anything that is broken. The house is not newly renovated, and it does require some painting work and that's why Nicole is willing to lower the rent for her, but Nicole made it very clear on the initial meeting that the house is renting in as-is condition and *** agreed to it and put down $1000 the deposit for the house and signed the lease with lease starting date on 11/20/2019. After few weeks went by, *** want to go back to the house and do some cleaning and painting herself, but after she visited the property the second time she decided to ask Nicole to do all the cosmetic work, and text her a whole list of requests included painting, kitchen appliances needs to be clean, newer bathroom, ETC. Nicole didn't agreed to it and *** decide not to rent and want the security deposit back. The general purpose of the deposit is to protect the landlord of possible financial loss and to assured tenant landlord will take the house off the market and will go through with signing the lease with the tenant. Landlord did take the house off the market and left the house vacant for few weeks waiting for *** to get ready to move in, so for that reason Landlord is only willing to refund half of the deposit and keep half of the deposit to cover for her time and financial loss now that she has to look for a new tenant again. But cut the story short, it is Nicole's negligence for not put renting the house in as-is in written agreement and therefore she already refund the other half of the deposit back to ***. Also just to clarify the fact, the Lead test was done on Nov 5th, way before the lease start date, please see attached proof. Thank you so much for your time and concern.
