Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below I also received this documentation from them directly and before receiving this email, this is how I responded via email:I have reviewed the documents you attached, however I do not agree that thisis a reasonable solution I was told verbally that if I decided initiallythat I wasn’t happy that this could be cancelled I initially went intoyour facility for a “free” training session where I spend 20+ minutes beingpersuaded into joining I was verbally assured that I could cancel, andnow it seems that the company is set on not only keeping but obtaining evenmore money for a service that I was both unfamiliar with as well as convincedthat I would not have any issues cancelling if done in the 1stmonth It is my hope that you will again reevaluate the full dynamics of thesituation and come up with a better way to resolve this Regards, [redacted]

This is the email response we sent to the client I also have more attachments of the Membership Agreement that I would like to add if possible.Hi ***, I have attached all of the documents that we have for your membership I have attached the signed membership
agreement, and the carbon copy We understand that the membership agreement can be lengthy and sometimes misinterpreted since it was drafted from a legal stand point To combat this problem we came up with the carbon copy that gives you a quick synopsis of your membership, it's terms, the length, price, cancellation and billing policies Please reference this attachment and see that you initialed off on each bullet point, printed and signed your name We are sorry to hear that you do not want to continue with our services We feel that we have a great product, service, and a very high satisfaction rate. There is not any documentation about the canceling of our services with you up until this point We would like to move forward with you and get this resolved Per the membership agreement that you signed if you want to cancel before your term has matured there is a cancellation or "BuyOut" fee that is assessed Once this fee is paid your membership is completely terminated with HomeFit You currently have paid $towards your membership We are definitely willing to apply your current balance to your BuyOut amount Your current BuyOut amount would be $($a month membership x months left = $x .35% BuyOut rate = $350) This $would usually be in addition to what you have already paid ($+ $= $600) We would be willing to apply the funds that you have already paid to your BuyOut amount, leaving a $balance Once this $is paid, you would be relieved of your contractual obligations with HomeFit We hope that you see this as a reasonable solution. Please see attached document where [redacted] clearly signed the membership agreement 3x entering into contract with HomeFit for 52 weeks.  Ms. [redacted] was given by the state of Kentucky 3 days in which to re-read her agreement and decide to cancel with HomeFit for a full refund.  There was...

never an agreement that she could cancel after one month without penalty otherwise it would be stated in her contract terms.  Ms [redacted] completed chargebacks for her payments, we provided [redacted] a copy of her contract, and they sided in HomeFit's favor.  All of her paperwork was very clear, and signed off by her 3x, and by a HomeFit representative.  She spoke with a representative yesterday, and there was a problem with communication with both parties so we asked her to type up an email and send it to us.  She instead sent it the Revdex.com, without awaiting our response.  Had Ms. [redacted] followed the instructions we gave her, she would know that we cancelled her contract yesterday 9/2/15 without penalty even though she very clearly signed the contract and did chargebacks that [redacted] sided in our favor over.  Its unfortunate that in this time people can enter into contract with companies, complete as many costly chargebacks as they want, and then submit complaints to the Revdex.com that in turn hurts small business like ours.  We gave Ms. [redacted] the best service possible, and still she was able to just "quit our service without penalty", because she felt like it... even though she was under contract.  Ms. [redacted] has been relieved of her contractual obligation, and we hope that next time she is presented with a contract she knowingly hold up that obligation or not sign in the first place.
