We purchased a house to be built back in October of 2018 and the builder *** said it would taker no more than 6 months/. A year later the finally finished it or supposedly finished it. There are several discreprencies that where noticed and the builder refuses to correct. First one is the outside brick does not go all the way to the ground and looks totally unfinished and his excuse was that the ground it hilly which its not and none of the other houses he built looks that way. the second is the doors leak air through bad and in need of insulation. The back door is missing a third hinge and wobbles when opened. The third item is the painters he hired used the wrong paint to paint the garage and adjacent rooms. We had to pay over 600 dollars out of pockets to correct it because he refused to answer our calls. Fourth, in the contract he kept having me sign extensions on building the house which took longer than he said it would and I did not sign the last few month but he turned it into the locals as me signing it which is forgery. We asked in the contact to have a vent form the furnace installed in the garage and it never was even though the furnace is next to the garage interior wall. In all we paid over 16000 dollars extra besides the cost of the house to at least make it livable and still paying.

A contract was signed in Oct 2018 to build home based on a spec house in theneighborhood with a projected close date of May 15, 2019. The home was to be builton a lot selected by the buyer. The lot contained a huge oak tree estimated to beover 300 years old along with other smaller trees. The large tree would notinterfere with the construction of the home. However shortly after foundation waspoured weather moved in and slowed down the construction process. Asconstruction started the buyer insisted on having the tree removed prior toconstruction of the home. I refused to have the tree removed but allowed the buyerto have it removed. Thus causing another delay.As we proceeded with the construction and completed the framing of the home Iwalked the home with the buyer. She decided to add 2 additional windows to thehome -1 in the hall bath and 1 in the lower bath. The windows have a 3-4 week leadtime to receive. Sometime with in this same time period the buyer decide that shedid not want fiberglass inserts but wanted all tile showers in the master and lowerlevel baths. The issue with this is we had to cut up concrete floors to reposition thedrains system to allow for tile showers. We also had to tea rout framing andreconstruct for the shower difference. All of this had to be completed prior to anyother contractor performing any work. Both of these items added to additionaldelays. Scheduling and sequencing is paramount in the construction of homes. Withthese types of delays the other contractors have to adjust their schedules are nowout of sync. Not to mention additional costs to me for calling them back.As we went through the process of electrical, insulation, drywall the buyer wastrying to decide what her colors were going to be, along with tile selection, stoneselection and all of the other items. The buyer was very indecisive on all of theseaspects as she kept changing her mind.So after a multitude of changes I decided to go with her to select her kitchencountertops. The spec calls for granites with an allowance by grade. So on July 30 at1 pm we met at the countertop supplier for her to make her selection. We went intothe warehouse to view the actual slabs of granite and explain which types wherewith in her allowance. She actually upgraded her granite and we scheduled. Which isusually a 3 -4 week process. Measuring, making templates and actually processingthe granite in the shop in preparation for install. Once we got them installed sheactually told me how great the kitchen looks with the paint and granite countertops.And in her texted words “ we could not have done better it’s simply the best betterthan all the rest I am 100% so happy “ on August 14. In addition in another text onthe same day she stated “I don’t just like it I simply love it”.Her tile selection was changed several times from the original, which she hadselected from another home in the neighborhood. Before it was finalized I sent he toanother vendor for selection on Aug 15. Once again this varied from the spec sheet.Additionally I had to utilize multiple tile setters due to the types of tile selected andchanging the way it was installed adding more delays.On Aug 27 they were installing stone and I sent her a picture and she told it was notthe correct stone. I had to have it removed. I attempted to show her different itemsfrom other homes so she could make a determination of what she wanted. Shechanged her mind at least 3 different times on stone. Selecting one type of stonefrom a house she had seen that I have no idea where the stone came from. I had hergo to the vendor and select another. Thus causing another delay and additional coststo me.The spec sheet designated that the front would be lap board siding and the sides andrear would be sheeting. Stone was to be installed around the garage doors and frontdoor. We installed stone below the cantilever in the front around the bedroomwindow-which was not on the buyers spec sheet – but as the prototype home wasbuilt.She told me she wanted to stay with in budget on the vanity top selection butwanted a gray swirl in the pattern. So I ordered tops that complied with herselection. After they were installed she got really upset because she did not selectthem. I thought because the granite looked so nice was why she did not want them.So I had them removed. She went and selected another type from the countertopvendor which is actually different from my normal supplier for vanity tops. Thusadding another delay and once again costing me additional money as I have an extraset of vanity tops and more interest to pay. The countertops in the kitchen andbaths are measured and custom made to go with the custom made cabinets for eachhouse.In September the buyer and husband went to the plumbing supply to select faucetsand finishes. They made their selection and the products were ordered. Theplumbers kept trying to contact the buyers to pay for their upgrade and they wouldnot respond. Then out of the blue the buyers called and said they were bringingthere own plumbing finishes to be installed. I informed the plumbers of the change.The plumbing company told me that must be why she is not returning may calls.They had to return the products and paying a restocking fee which was passed on tome. Another additional cost for me. Sometime after delivery of the products it wasdetermined that they did not purchase enough products to complete the finishes. SoI still had to go purchase more supplies to complete the plumbing finishes.In September the buyer and husband were both in the driveway looking at the homeand discussing the shutters that were to be installed. They were to be white withlouvers which we all agreed. These were installed the last week in October. Anothervariance from the spec sheet and the prototype home with no charge. Also these arethe same type of shutters installed on all of the other previous homes with shutters.She did not like them and asked us to remove the shutters Oct 31- the day afterclosing. This is when she decided the exterior trim paint was not correct – but thetrim paint was exactly the color she selected.We painted the home according to the paint selection she provided. We weredelayed several times because she was indecisive on what she wanted. At one pointshe wanted silver metallic paint on the garage doors. The home was painted in Julyand there was never any said about the paint being the wrong colors until afterclosing. We even painted an accent wall in the master bedroom and the lower levelbedroom for the buyers - which is usually an additional charge that we did notcharge for.Oct 29 & 30th the home was cleaned and our walk thru was performed. She washaving the additional appliances delivered. Home Closed.Nov 10th she asked if we could send the cleaners back – which we did on Nov 11th.Nov 11 I received a credit memo from the appliance company for this house as theywere picking up all of the appliances with a comment “Customer wasunreasonable with all salespeople and myself. Returning all product andissuing full refund. Last stop of Day.”During the last few weeks prior to closing I found out there had been confrontationwith the sales representatives at the countertop supplier, appliance supplier,lighting supplier, plumbing supplier and landscaper.On Nov 14 I sent the buyer a message and requested her to put the utilities in hername. She told me she wasn’t living there yet.On Nov 22 I sent her another message to have the utilities put in her name. I wasgoing to shut them off. She again told me she hadn’t moved in yet then startedberating me while cursing me via text messages.After Closing Oct 30 – The buyer had the kitchen countertops replaced. This is afterher telling how perfect it all was – couldn’t be better on August 14.Through all of the delays and changes the buyer kept saying she knows it take timeand weather plays a big role on completion and that she doesn’t care how long ittakes. Each time I told her I cared because it was costing me money as I am payinginterest on the loan.During this time frame she had 3 different lenders as we had to provide paperworkand interact with for documentation. I finally I told the last lender that I would notextend the contact any more. I was tired of all of the changes and delays as this iscosting me a large amount of money in interest carrying the loan along with all ofthe changes.Now I will address each of her specific disputes in the complaint:1. The brick does not go all the way to the ground and looks totally unfinishedand his excuse was that the ground it hilly which its not and none of the otherhouses he built looks that way.The stone on the front of each house only goes to the bottom of thewindow. This is designated on the spec sheet- Which both buyerssigned.If she would have let my landscapers complete their job there would belandscape covering the lower portion of the home.2. The doors leak air through bad and need insulation. The back door is missinga third hinge and wobbles when opened.I did have the framers go and adjust the doors as required. I did notknow anything about a missing hinge but will address.3. The painters he hired used the wrong paint to paint the garage and adjacentrooms. We had to pay over $600 out of pocket to correct it because herefused to answer our calls.The garage paint is not selected by the buyer. I always use a flat white-most builder either don’t paint or charge to paint the garages – I did notcharge. As for the adjacent rooms they were painted the color sheselected- including the accent wall that was painted at no charge. Therewas never any compliant about the colors in the few months prior tothe closing. The buyer was through the home many times during thistime period.4. In the contract he kept having me sign extensions on building the housewhich took longer than he said it would and I did not sign the last few monthbut he turned it in to the locals as me signing it which is forgery.When closing did not take place as scheduled due to numerous delays -extensions were required to maintain the contract. I did not sign anycontract for her or anyone else. Actually she told me she did not need tosign any extensions but I insisted she sign.5. We asked in the contract to have a vent from the furnace installed in thegarage and it never was even thought the furnace is next to the garageinterior wall.Installation of a vent in the garage in NOT allowed per the buildingcodes. There was never anything in the contract or spec sheet to installa vent in the garage.6. In all we paid over $16,000.00 extra besides the cost of the house to at leastmake it livable and still paying.Any and all extra money paid was due to buyers choice by selecting outof contract items and upgrades throughout the build process. I will behappy to provide any detail listing of upgrades.The home would be “liveable” just being built to the original contractand specs without any upgrades and probably not any delays. When abuyer starts changing items during construction it almost alwayscauses delays.Settlement Resolution:I will add more stone to the front of the home below the window even thoughit is not in the contract or spec sheet or prototype home thus costing me more$$$ again.I will perform any warranty work requested through the normal warrantyprocess.I will address the missing hinge and door leaks.I will not install shutters as I have already done so once and had to removethem because she did not like them.I will not reimburse for painting they had done.I will not add a heat vent in garage as this is NOT within building codes.

I have enclosed pictures of his unfinished work and his excuse was the ground is uneven which is not true at all. The door hinge is missing as well as all the doors are hung uneven causing cold air to rush through. I have pictures of all that he has failed to fix and will not answer any calls from me. I tried to attach more photos but it will only attach one. *** knew the front door deadbolt was difficult to lock and that you can barely turn the lock because it doesn’t fit properly inside the door frame. *** sent a guy out to fix it, the guy came out and made it lock, but he was supposed to come back and drill more in the space that the deadbolt goes, but he never returned after the first visit. photos to show how *** builds homes with cheap shortcuts and poor quality of work. The trim around one window outside is missing along with the stone that he stopped using and looks awful. people in the neighborhood all say the same thing and complain about his work and not fixing anything.
