Home smart reality in White Plains Ny
Is it a code of ethics violation if your realtor wanted to show your home during the pandemic? – NO. WITH A HOMEOWNER’S PERMISSION AND WHILE FOLLOWING DOH AND STATE COVID PROTOCOLS, SHOWING COULD TAKE PLACE.
He was told only if they wore proper protection. IF SHOWING WERE TO TAKE PLACE, ALL COVID PROTOCOLS WOULD BE REQUIRED, INCLUDING THE WEARING OF A MASK.
His response was he couldn’t ask them to do that leading us to remove the house listing during this pandemic for our safety. ALL COVID PROTOCOLS MUST BE OBSERVED TO CONDUCT A SHOWING, AND THE AGENT COULD REQUEST THAT PEOPLE WEAR MASKS, TAKE PRECAUTIONS, ETC. TO SAY OTHERWISE IS INCORRECT AND POTENTIALLY A VIOLATION OF THE CODE OF ETHICS (MISREPRESENTATION, AND NOT ACTING IN THE CLIENT’S BEST INTERESTS)
Also his broker refused to solve the contractual agreement and would not respond by phone instead sent an email. A BROKER MUST COMMUNICATE WITH HIS CLIENT IN A TIMELY FASHION. FAILURE TO DO SO MAY BE A VIOLATION OF THE CODE OF ETHICS (NOT ACTING IN THE BEST INTERESTS OF THE CLIENT).
We were also never told the contract would be for 15 months and not given a copy until June when we insisted ( we listed in Febuary) FAILURE TO PROVIDE A COPY OF THE CONTRACT COULD BE A VIOLATION OF THE CODE OF ETHICS. YOU WOULD BE REQUIRED TO REVIEW AND THEN SIGN THE CONTRACT. DID YOU LOOK AT THE CONDITIONS?
I’ve had a hard time getting this resolved I want out of the contract. UNFORTUNATELY, I CANNOT GET YOU OUT OF YOUR CONTRACT. THAT IS BETWEEN YOU AND THE BROKER. HOWEVER, IF YOU WISH TO FILE A COMPLAINT AND POTENTIALLY PRESENT YOUR CASE AT A HEARING, ALONG WITH THE AGENT AND BROKER, I CAN ASSIST YOU AND PROVIDE YOU WITH THE NECESSARY DOCUMENTS.

Horrible ,Violated about 3 codes of ethics ,no responses from broker He hid behind an email response .Their contracts are for 15 months long so you could be stuck with some one not willing to sell your home

This is a dispute between buyer and seller. Below is the seller's response to their complaint. We did recommend the new homeowner contact their insurance company to file a claim. Hello [redacted] This is absolutely absurd to receive an email of this nature... accusing me of stealing an R/O? Not to mention, I find it a little disturbing to be hearing about this over a week after closing on this property!!!! Please understand that I will not tolerate this type of treatment, as this is a recipe for disaster! As you know, I have health issues which is the reason I was selling the house below market value to begin with. I will be going through medical tests the next couple weeks, and will have to refer to my attorney's for future correspondence as I have informed them of this ridiculous accusation. I have provided them with the file and let them know of all the issues with this transaction from the onset. **, I am very sorry that you have had to deal with this type of transaction as this is a first for me as well. As you know, I have been involved in real estate for over twenty five years and the conduct from the buyers agent is a first for me. Please just look at this unfortunate transaction as a learning curve of "real estate transactions gone wild!" as it will make you a better person as you move forward with your real estate career. Please remember that we are only here for a short visit and one needs to appreciate and enjoy each breath we have been afforded. Please do not let this buyers agent sidetrack your vision and inevitable success. I wish you well as you have been extremely professional, ethical with the utmost integrity during this entire transaction. Thank you for your time, ***

This is not between the buyer and the sellerThis dispute is between buyer and the seller's real estate agent.She kept the keys and garage door remotes to the property overnight after the closing day.The seller's agent and Home Smart Realty employee ** *** delivered only one key to the front door on the day of the closing, that too, after the Scottsdale Police Department got involved.She kept the second key to the front door, the clickers for the subdivision gates and the garage door remotes overnight and delivered them at the guardhouse the next morning.All the keys and remotes to the property should've been delivered on the day of the closing.The agent had access to the house on the night of June 18th, the closing day and that's when the RO system went missing.Why was only one key delivered on the day of the closingAfter the closing, the property technically belonged to the buyerWhy did the seller's agent keep keys and remotes to the buyer's property and only delivered one key on the night of the closing?
