I am writing in response to your letter dated 3/11/14 regarding complaint #9939350 filed against my company.
To begin, I think it is important to make clear that the home in question is a Manufactured Home that was installed on concrete
pier footings in January of 2012. The site is in a flat, low-lying area less than 300' from the banks of Pennsylvania's largest
natural lake.
This complaint was investigated twice; once by my lead foreman on 2/4/14, and once by me personally on 2/5/14. Subsequent
to our physical inspections, I brought the matter to the attention of the local code authority. Collectively, we concluded that
the problems were likely the result of frost-heave due to the extremely cold weather and the abnormally deep freeze
experienced across the northern tier of the country this winter rather than the fault of Bayshore Homes and/or incorrect
construction methods as alleged in the homeowner's complaint.
I reported our findings back to the homeowner on 2/6/14 at which time he acknowledged and agreed with our assessment,
stating that his family had occupied that parcel for more than 30 years and he was well aware of the concept and effects of
frost-heave. In fact, during that conversation, he actually said [quote] "I didn't say you did anything wrong". Despite his
admission that my company did nothing wrong, he made it clear that he expected the issues to be resolved at my expense.
When I offered my "help" [i.e. equitable participation in a solution] in lieu of bearing the entire expense and responsibility of a
corrective action, he interrupted me with a threat to speak negatively about my company and then hung up on me before a
resolution of any kind could be discussed. I regarded that to be his refusal of my help and considered the matter closed.
Bayshore Homes has an exemplary reputation not only for the quality of workmanship but also the care for our customers after
the sale. We do, and will continue, to go above and beyond our contractual responsibilities to ensure our customer's
satisfaction, but it is unreasonable to expect that we accept the responsibility and suffer the expense to combat acts of nature.
I am at your disposal to provide further explanation and/or answer any further questions you may have in this matter - feel
free to contact me at your convenience.

Response:
I read the letter but disagree that he offer any type of help. if he did we would not be in this situation. he also said that the ground in this area is low and close to the lake. well he should have known that the frost heave would be more serious and allowed for that when he installed the home. I am willing to work with him if he is willing. I will take care of the two porches, if he will take care of the skirting by using better material and installation.
