From: Mike C*** < [redacted] [redacted] @***.***>Date: Tue, Aug 1, at 4:PMAs you stated in your address, there are two sides to every story [redacted] did contact me via hand delivered letter requesting that someone contact her in regards to her complaint Once her letter was received I had to conduct an investigation to gather all the facts related to her complaint MrsF [redacted] is a realtor and can only legally represent one in a very limited capacity which does not give her the authority to obligate Basically she is just a facilitatorTherefore, any agreement made by [redacted] was done by her accountThis offer was reviewed in person with [redacted] where she knowingly, willingly and intelligently signed her name to the terms of the agreement At no time was this an issue until the day of settlementDuring my investigation MrsF [redacted] provided me an email sent by [redacted] where they has discussed the situation and [redacted] ’s response was, “ I guess I should of read the documents more carefully.” [redacted] was advised of many things which she disregarded One item in particular was the offer price of the home She was advised that the home was overpriced by $10,and would never appraise She was also advised that if she purchased the home at full asking price and later had to sell, it would be likely that she would lose that $10, Not only did she go with the full asking price, she also waived the right to conduct an appraisal and protect herself from overpaying The only reason the deal went through was because she was a cash buyer and waived those rights She also waived her right to make the sale contingent on a Home Inspection against our recommendationAfter concluding the investigation, I had my office Manager MrL [redacted] speak with [redacted] When I inquired to MrL [redacted] how things went he stated, “I felt like her punching bag and was not receptive to anything he had to say.” Shortly after that I did receive a second letter from [redacted] where I did ask MsF [redacted] to contact her and try to see if she could talk things out with [redacted] She called a few time with no response and left voicemails She also sent an email to follow up with those voicemails still without a responseIn response to her accusation about the home warranty; it is illegal for any settlement company to offer kickbacks for the use of their settlement services and that is why she was advised not to use that company If she wanted a home warranty she could of negotiated that in the offer but again, [redacted] was not interested in our advice and chose to dictate the terms in which she wanted.Again, [redacted] , knowingly, willingly and intelligently signed the offer and the offer reflected her terms As you can see [redacted] disregarded our advice during the transaction so everything that exists in the transaction was by her own accountIn years of business we have never had a complaint This is a frivolous claim and all could have been avoided if [redacted] would of taken our counsel under considerationI hope this helps out and if you have any further questions regarding this matter please do not hesitate to contact meRespectfully,-- Mike C***Broker/OwnerHomestead Realty Licensed in VA, MD, DC State Licensed Real Estate InstructorOffice Phone: ###-###-#### Mobile Phone: ###-###-####Fax: ###-###-####eFax ###-###-####email: [redacted] [redacted] @***.***

I am rejecting this response because:The facts stated in the response are incorrect and did not address my concern of the rent-back period. The office manager never contacted me.  The only time I spoke with the office manager was when I called the office in an attempt to speak with someone after not having received any response from my first letter.  The office manager was not in a position at that time to offer a solution because he was unaware of the issue until that call.  He was hearing my complaint since no one had reached out to me.Ms. F[redacted] attempted to reach me after that phone call with the office manager.  After that time, she only reached out to me to orchestrate the walk-through at the end of the seller's rent-back period.  That was it.  I did not take Ms.F[redacted]'s previous calls because she had made it clear there was nothing she would do to solve the rent-back issue. My concern continues to be that Ms.F[redacted] willingly and knowingly led me on regarding the rent for the rent-back period.   I repeatedly asked how I went about getting the rent checks and Ms F[redacted] repeatedly told me she would help with this.   Even so much as to agree that it was a good idea to have the cost of the items I was purchasing deducted from a future rent check.  This is my complaint with Ms F[redacted] and with Homestead Realty. I resent the words that I dictated this purchase to Ms. F[redacted]   Ms. F[redacted] knew I had not purchased a home in 30 years, was going through a separation with my husband, was in the midst of cleaning out the home of my parents' who had recently passed away , and was out of the country for one of the less-than-two-weeks of the contract period.  Ms F[redacted] assured me, repeatedly, that she had my back, and was working out the best contract to secure acceptance of the offer.Furthermore, Ms. F[redacted] advised that I not have a Home Inspection at all. It was only because I insisted that I was able to have one at all.
