The customer did contact us in December of concerning the title issue. It is our obligation to try to resolve the title issue before a claim is filed with the title company. The closer on the file tried to work with the other party involved but the other party was not
responsive at first and then would not cooperate at all. The complainant in this case called our office several times and was told what the situation was. Once the closer determined that the issue could not be resolved on our end, the title insurance company was then contacted. Once a claim is filed with the title company, our office nor any employee of our office can talk with the client concerning any aspect of the claim. The complainant was told this several times and was very irate that we would not communicate with her. She called the local title insurance company office and was told the same thing but the complainant later called our office to say that a representative of the title company said our office was negligent in not filing the claim earlier. We confirmed with the title insurance company legal counsel that no such statement was made and the complainant was told they NOR our office could discuss the matter with her. I am sorry that the complainant was not satisfied with our efforts but we did our due diligence in trying to resolve the matter first

I am rejecting Homestead Settlement’s response as inaccurate.  I contacted them in December regarding the title search that they performed for my home purchased in February 2015.  I paid them a sum of $385.00 to perform this search and they failed to perform the duties for which I paid them.  The result of this was an additional lien from the previous home owner on the home that I purchased.  At every attempt to resolve this matter, I was met with resistance.  It was not until I started to demand this be corrected that anything was done.  That was approximately 2 months of asking for a resolution to their error.  In addition, this company shared my information with another party which violates my privacy rights and they shared with me details of the other parties obligations (another privacy violation).  Mistakes occur daily – but when a mistake is made, it is incumbent on the company/person that makes the mistake to make it right.  This company did nothing to correct their mistake and cost me time and distress which equals far more than the $385 that I am requesting.  They did not perform the job for which I paid them to do in an adequate manner that resulted in an additional lien on my home that was not my obligation. Please advise on how to proceed. Regards, [redacted]

Review: I paid this company at the closing of my home to represent me, and to communicate with my title insurance carrier should a problem occur with the title to my recently purchased home. I was not represented in a timely, professional, and courteous manner. I was lied to, and was lead to believe that a claim was filed back in 12/2015. A claim was never filed until 2/2016. This was confirmed by my title loan company as well.Desired Settlement: I am requesting for the $385 that I paid to this company at my closing be refunded. I am requesting an additional $115 for my time with repeated phone calls, the misleading information provided to me by the owner, and the employees at Homestead Settlement. This amount is a fair request for the stress that this company has casued both to me, and my family.
