Revdex.com. Honest Home also respects the long established Revdex.com’s efforts to serve in its role to help resolve disputes between consumers and businesses.  However, unless such matter is resolved by payment or a proposed payment schedule by December 21, 2016, Honest Home, will exercise its right to properly resolve the matter legally in court. Nevertheless, to provide a response to the Revdex.com regarding this issue, Honest Home, provides the following information. Summary of the Facts and Argument Honest Home, a small business home improvement retail merchant, made an honest mistake in initially quoting the Customer by entering an incorrect unit of measure resulting in an incorrect quantity of goods that further resulted in an error in the extension of the initial estimated price for flooring materials. The mistake was subsequently found and was properly corrected. The mistake was a remedial clerical error and that the Customer was genuinely aware of or should have been aware of the mistake. Instead of doing the honorable thing and informing Honest Home of the mistake, the Customer chose to take advantage of the new employee’s mistake and hopefully benefit from receiving and accepting a larger quantity of goods than what was initially and erroneously quoted. Although the quote was later confirmed, and properly corrected, the Customer remained silent permitting the Customer with the opportunity to later object to the agreement only after the materials were actually installed. Honest Home states; that the Customer received and accepted a greater quantity of materials than what was initially estimated and what was initially paid for; that the Customer had knowledge of the mistake; that Kentucky statutory rules and case law resolves such issue wherein the Customer’s acceptance of a larger quantity makes the Customer liable to pay the purchase price of the quantity of goods accepted; that in accordance with Kentucky statutory law, the buyer must pay at the contract rate for any goods accepted.  Absent a prompt payment or proposed payment schedule from the Customer, Honest Home will proceed with legal proceedings to resolve this issue.  Respectfully, [redacted]

February 13, 2016 Conciliation Department Revdex.com 844 S. Fourth Street Louisville, KY 40203  Reference:  Complaint ID [redacted]  As requested, listed below is Honest Home’s second written response to the above referenced complaint. Summary of the Facts and Argument Honest Home Second Written Response Honest Home is not accusing Customer of wrongdoing. However, based on research of Customer’s historical records, the Customer received two prior quotations showing that flooring materials alone would cost $1,000 leading Honest Home to the conclusion that the Customer was well aware of the approximate cost for flooring materials and therefore, Customer was genuinely aware or should have known that the February 2016 quotation was a mistake. Honest Home disagrees with Customer’s statement regarding Owner double checked initial quotation. Honest Home does admit Owner participated in an event to resolve issue where delivered materials did not match Customer’s specifications. An important fact is that after discovering the mistake, Honest Home contacted Customer to explain the mistake and to discuss resolution. During that telephone conversation, Customer agreed to pay the correct amount. However, only later, a partial amount was paid toward the correct balance owed and then a complaint was filed with the Revdex.com. Owner will reach out to Customer again. Absent a prompt payment or proposed payment schedule from the Customer, Honest Home will proceed with necessary legal proceedings to resolve this issue. Respectfully, [redacted] Managing Member [redacted], LLC D/B/A Honest Home

The response from the business states that I knew about the mistake and I chose to take advantage of a new employee to pay a lesser price. This is simply not true. I did not know that a mistake had been made until several months after the floors had already been installed in my home, when I received a bill from Honest Home. The bill came with no explanation after I had thought we were completely paid up. Furthermore, the fact is that the business owner actually double checked and verified the order and billing amount at the time we paid for the product. The new employee that was referenced actually did ask for help to make sure he was doing everything correctly. I did my due diligence to make sure the order was being processed correctly, and I feel that the business owner is accusing me of being dishonest, which is very offensive to me. I was hoping that the business owner would take responsibility for the mistake and at least apologize for the surprise bill and work with me in a professional manner to agree upon a resolution, but instead I am being accused of wrongdoing.
