Case # ***: Mr*** ***Attention: Ms*** ***According to our records, we initially responded to Mr***'s complaint, initially listed as case #*** in September We had not heard any response since and assumed the issue was resolved.The
bins were removed on August 29, We did have two documented incidences on August 20th & July 23rd of the refuse bin being overloadedWe had not received any communication from Mr*** prior or immediately following either of the two aforementioned dates.We acknowledge that Mr*** had had periodic problems with the cardboard pickup previously and had been credited for those errorsWithout any record of the service being interrupted and with the knowledge that one of our more experienced drivers services the refuse in this area, the charges are deemed to be valid.We would be more than willing to review any evidence or records that may substantiate Mr***'s assertion, but reviewing these items two years after the fact would be difficult at bestAt this time our collection agency has control of this account and we would need to present substantial evidence to have it retracted

I am rejecting this response because:
Dear [redacted]:In response to Mr. S[redacted]’s reply to my complaint, ID #[redacted], there have been multiple times when Honolulu Disposal Service failed to uphold their side of the service agreement as to the scheduled days of waste and cardboard pick ups. As far as my understanding goes, when any service is scheduled for a certain day, that service is to be performed on that scheduled day. For example, if you have trash pick up from the City and County scheduled for every Monday, then a City and County refuse truck comes through your neighborhood and picks up your trash.  As a result of Honolulu Disposal Service not upholding their side of the service agreement we terminated the agreement with them and have since been using [redacted], who may I add have been more than accommodating to us than Honolulu Disposal Service [redacted] has always picked up our trash and cardboard refuse on the scheduled day.  As far as the $57.53 that was sent to collections by Honolulu Disposal Service we would be more that happy to have paid it off, if it were a legitimate balance. We had a verbal agreement from Honolulu Disposal Service in 2013, prior to terminating the service agreement with them that whatever balance we may have had with them would be credited back to us as for any inconveniences we experienced as a result of their negligence as to our scheduled trash and cardboard pick ups. The whole reason for my complaint is that it is the principle of the matter. The $57.73 is barely enough to even fill up some cars or trucks with today’s gas prices. If the representative from Honolulu Disposal Service whom I had spoken with at that time in 2013 had not stated that we would be credited back for any outstanding balance, we would have just sent in the payment on time like we always did. However, because we were told that we’d be credited the outstanding balance, once again, we expected Honolulu Disposal Service to uphold their side of the agreement. Which just like their service agreement, they did not. Any business person knows that your reputation precedes you and your word should be upheld. This is the reason for my complaint. Thank you for your attention to this matter. [redacted]

We have made every effort to expedite this matter as quickly as possible. After our Safety department conducted a brief investigation and obtained the...

police report noted, the matter was turned over to our insurance company, [redacted] Insurance. [redacted] Insurance has since conducted their investigation and has deemed our driver was not at fault and has denied the claim; letter dated July 18, 2014 is attached. Discussions with the driver from Honolulu Disposal & [redacted] Insurance determined that the driver's operation of the vehicle could not establish fault on his actions, despite his initial acknowledgement.
It is the normal procedure that once the incident is turned over to our insurance carrier, they will handle further communication with the complainant from that point.
We feel every effort has been done to deal with the complainant in good faith and seek resolution.
