Review: My car was recently repossessed on 9/19/13 and after contacting the towing company numerous times, a person by the name of [redacted] repeatedly refused to provide me with the physical address of her business so that I may pick up my personal belongings and also insisted that if I wanted to retrieve them I would have to pay $190.00 (as of 9/19/13) or the charge would go up to $265 by 9/20/13 (plus $40.00 for each additional day).On 9/20/13 the social worker where I reside tried to contact [redacted] to make arrangements to pick up my belongings pursuant to Vehicle Code Section 22651.07, wherein it states that I may retrieve my personal property free of charge during normal business hours and that the towing company must accept cash or credit card payment if there are additional towing/storage charges. [redacted] refused to provide an address, repeatedly refused to accept anything but cash payments and was very rude and unprofessional to everyone who tried to contact her on my behalf. At this time I would like to file a formal complaint against this business for unfair and possible unethical business practices.

I would like a refund of my $200.00 cash payment, in addition to a post dated check of $65.00 (in the event that it is cashed) and reimbursement for gas expenses in the amount of $100.00 for having to pay someone to drive me to a gas station located in Fairfield, CA per [redacted] request. I would also like reimbursement for any recorded usage on my Fast Track pass, which she failed to return with the rest of my belongings, starting as of 9/20/13 to date.

Initial Business Response

She keeps on referring to us as a tow company and we are a Repossession company. The laws and vehicle codes are different for tow and repossession companies. We do not have the same vehicle codes and as a repossession company we can charge for removing, inventorying and storing personal property.

She was provided an address and was crying, because she had no vehicle and no way of coming to Sacramento from Livermore. I agreed to meet her half way in Fairfield, she did not show on 2 appointments I had set with her and drove the 45 minutes one way, to only wait without a curtsey call from her, for nothing, waisting my time and fuel.

She had her case worker calling me and my office and tried to strong arm us in to delivering the property to her free of charge. I advised her case worker that I will not discuss this case with her, since she was not on the contract.

Me, nor any of my staff members was ever rude to her at anytime, even when she was threatening us with vehicle codes, that she had no clue about and that did not apply to repossessions, but a regular tow company.

I advised her after being stood up twice that her fees would accumulate every day until she picked the property up. I eventually stopped the daily storage, because I felt sorry for her.

She did finally meet with me and gave me a check that she post dated and then the check NSF.

She is a very rude, inconsiderate and unethical person. I was nothing but kind and nice to her.

She needs to google "can a repo company charge for my personal property" and she will get a response from the BUSINESS BUREAU OF INVESTIGATION SERVICES and the CALIFORNIA LICENSE REPOSSESSION ASSOCIATION. I did explain to her on numerous time that she was not towed, but Repossessed and therefore she is being charged for her property.

I have turned the check that she NSF over to the DA's office, so they can pursue with criminal charges against her.
