Per ***’s policy, I must get a termination of contract between the Client and ContractorI have included the Mutual Termination of Contract returned from Mr*** as “not acceptable”. I have on several times tried to explain once we get an acceptable termination of contract I will return the funds received by *** less the $fee I am owed and less ***’s dealer fees I cannot release this amount without Mr***’s acceptance of the termination agreementAs always, the decision not to sign the termination contract is Mr***’sOnce Mr*** accepts this cancelation agreement I will promptly return the unused portion of his paymentI hope this helps and as always, please let me know if I can help in any way

Like most disputes, there are two sides to the storyUnfortunately Mr*** *** changed his mind about going solar at the last minuteMr*** entered into a contract for a rooftop solar system with NO money down as a depositAfter executing the contract Mr*** released a cash
disbursement from a third party financierThis financier paid Hooked on Solar less dealer fees of which Mr*** was aware ofHooked on Solar preformed a Site Evaluation, designed plans, pulled a permit with the local jurisdiction and scheduled the installation with Mr***On the day of his scheduled installation as the crew was in route, Mr*** called off the installationUnfortunately, from that point on Mr*** would not agree upon an acceptable solar system (ie rooftop vs ground mount)Once Mr*** asked to cancel his contract, we prepared a Termination of Contract outlining a minimum cost to cancel the contractThis Termination of Contract was presented on 7-13-and communication has always been open the entire timeI have had several emails, faxes and phone conversations with Mr*** explaining the costs for this project are way above the $I am asking for the late termination of his projectThe issue at hand is that Mr*** and Hooked on Solar must agree on the termination agreement before the bank will return his feesFurthermore, it has been explained several times to Mr*** that the loan is incurring finance charges each and every day this process drags onI wish to resolve this issue as soon as possible but I feel it is unfair to ask me to pay for everything because Mr*** changed his mind at the last minuteI am available to talk in depth about this issue at any timeThank you, *** *** *** ***

I think I am wasting your time and my time in attemting to resolve this dispute with Fralick construction.Mr. [redacted] says that I am misinterpreting the facts while he ignores thet facts that don't suit him.I appreciate the time spent by you and the Revdex.com but it is time to move towards more more drastic measures as were communicated to Mr. [redacted].Even [redacted] has received my complaint, state contractors Board will be filed by tomorrow and I will be trying to contact Sun power corporate. I have also left a message with my attorney. Thank you for your efforts.[redacted]

Mr. [redacted] is in error in most of his rebuttal. I did not change my mind about going solar! I only decided that because of the deceptive practices of 'Hooked on Solar' that they were not a company I wanted to do business with.I did approve a release of funds based upon a statement of 'Hooked on Solar' salesperson to the effect that by getting a payment to 'Hooked on Solar; in 2015 that I would then be able to obtain the tax credit. This was not true. Also, what is not true is that I was aware of any dealer fees that the [redacted] was going to charge 'Hooked on Solar.' It is also not true that I would not agree upon an acceptable solar system (ground mount). The only alternative offered to me by their salesperson was an inferior product in terms of output watts, warranty, etc.                                The termination of contract faxed to me on 7/13/15 in the "Surviving Terms & Conditions:Hooked on Solar is to return the disbursement of $3,955.88 to [redacted] for the benefit of [redacted]. If by 07/20/15 (7days from this termination contract) the funds are not returned in full, Hooked on Solar will reimburse [redacted] personally and [redacted] will pay off the remaining loan at his will."    The $3955.88 was never returned to [redacted] and there was no reimbursement to [redacted].The statement that "the issue at hand is that Mr. [redacted] and Hooked on Solar must agree on the termination agreement before the bank will return his fees "does not make sense. There are no fees to be returned to me by the bank. Also in a phone call on January 4, 2016, to [redacted] I was assured by [redacted] that Hooked on Solar could have returned the fees at anytime.During the last days of December 2015, I had at least two conversations with Mr. [redacted] asking him to return the money that he had been holding for almost a year to [redacted]. He did not comply as I found out on January 4, 2016. For reasons that I do not understand Mr. [redacted] is refusing to accept any responsibility for the misstatement by one of his employees that caused me to get involved with 'Hooked on Solar'.

Review: Fralick Construction Auburn Ca ('Hooked On Solar' [redacted]) Convinced me that the [redacted] solar panels were the best in the industry and that the solar tax credit would be available in 2014 if they received a first payment before year end. I agreed and they were paid $4659.50 on Dec.#0 2014. I decided that a roof mounted was not right for my property and was then given an option for ground mount panels using other than [redacted] panels. My accountant also informed me that the tax credit is only available when the work is completed. 'Hooked on solar' has not returned the funds to [redacted] nor to me. In a fax sent to me by Fralick Construction (Mutual Termination of Contact, Dated 7/13/2015) they are wanting $500.00 for labor,materials and fees to [redacted]. They were faxed back by me that this was not acceptable. I have heard nothing from them until today when I called and talked with '[redacted]' to no avail. They have had the $4659.50 for almost one year and are not returning the money.Desired Settlement: Fralick construction should return the money to [redacted].
