In the aftermath of Hurricane Harvey, Hooked Up RV Park, Inc., permanent residence to all tenants, is demanding full rent from tenants for the month of September, refusing to give credit for mandatory evacuation days in August and the weeks in September tenants were without water and electricityEven though power has been restored to the park, many sites are still without due to downed lines, poles and meter boxesI have spoken with management on numerous occasions, the last of which was today, requesting she speak with the owner asking him to reconsider his demand for September rent
The citizens living in this park are mostly low-income families and their homes have been devastated by Hurricane Harvey, most of them losing their home completely and everything in themTenants (with some help from disaster relief volunteers) were left alone for at least the first two weeks to perform all clearing of roads and cleaning of lots from huge fallen trees and debrisThere were no park

Thank you for your response to my complaint.I am rejecting this response because it still does not resolve the issue of charging rent when the property is uninhabitable. My lot is still uninhabitable because of scattered hurricane debris, including the neighbor's entire enclosed porch which slammed into the side of my RV and is now laying in my yard. I also have other scattered debris which includes tin that I think came from the roof of your
office. All if this scattered debris makes my lot unsafe and uninhabitable. We also did not have electricity or water for a good portion of September and a few days in October, yet the business refuses to even entertain the idea of prorating the rent.I believe none of your tenants should be charged for rent when the property is uninhabitable. Making the property inhabitable for its intended purpose is the business' responsibility and you can read that in the Texas Property Code. It is my opinion that it does not matter if it is not the park's fault, as I was told on the phone, that the hurricane rendered the property uninhabitable. It is, nevertheless, uninhabitable. The business cannot charge rent for the time in which a property is uninhabitable.

I have attached the Rules and Regulations that all tenants must sign before moving in. This is Kristi McBee that she signed. As you see she circled the $10.00 late fee showing she knew about it. Now if you look at the rules and regulation that I have attached you will see that what she is claiming...

is wrong.  If you look at Registration and Payment Details. She still has not paid for Sept or Oct. We did not charge late fee in Sept. If you look at Maintenance it states that it is the responsibility of each tenant to keep lot clean.  This is the big one Liability we are not responsible for accidents, injuries, or loss of property by fire, theft, wind, floods, or any act of nature which is beyond our control. She initialed every section and I have attached it for you to view. At the owners expense he came in and had most the tree removed that has fallen. We had no control over the electric and water due to the hurricane.
