Horacio's Auto Salvage

I bought a used engine from Horacio's to fit my truck but the engine I bought was not the engine that they said it was and the engine doesnt fit.I bought a used engine from Horacio's on March 2,2014. They told me that is was from a 2005 Dodge Dakota 4.7 v8. This is the motor I needed and would fit in my vehicle. They issued me a 30 day warranty. Well I ran into financial problems and was not able to put the motor in until August 6,2014. I took the motor apart and the motor is no good. The cams in the motor are shot. I called Horacio and he explained that my warranty was up and I agreed and fully understood. On August 9,2014 I purchased the part the fix the motor he sold me and then realized by the sticker with the serial number and year on it that the motor Horacio sold me was not from a 2005 Dodge Dakota like he told and what was written on my receipt but it is from a 2007 which is not interchangeable with my vehicle. He lied about what motor I purchased. I paid 1,177.00 for a 2005 motor and got a 2007 motor which I have no use for. He lied about the whole motor. Desired SettlementDue to the motor that I was given not being the motor on the receipt I believe I am entitled to a full refund of my money as on the receipt. Due to financial problems is the reason it took so long. The warranty covers a bad engine. But if the engine is not what you sold me that means I am entitled too my money back or a new engine. You can look at the document and it says 2005 dodge Dakota when they gave me a 2007. The business never once offered me a 1/2 price motor and I will not pay a dime to them due to the fact I paid for something I have yet to recieve. We can handle the problem personally or thru court it's up to them.Final Business Response WE have a recorded conversation with customer that stated he has bought a engine from an other source and wants money back ( Stated $500.00) and we can pick up old engine. In the phone call he stated that the cam shafts we bad, and he ordered parts and said that the engine was the wrong one. Dealer and Car-Parts on the internet state the 4.7L engine will work for the years 2003 to 2007 The only way you know if cam shafts were bad is to run engine. Why would you tear apart an engine with a warranty before you ran engine. We offered to Install an engine here at our shop just for labor and discount on another Engine. Now he states that he has spent $1000.00 on a different engine. This dose not sound right at all. We have tried several ways to work this out but we do not want any bad reflections on our company. Please get with customer and we will make a one time offer of $250.00 and we will take back our engine and after this is completed mark this issue as resolved to keep our good name intacked. Please call us at XXX-XXX-XXXX. Thank You!More info received from the consumer 2014-08-20The engine that I purchased is a over head cam engine which means the cams are under the valve covers. The engine had holes in the valve covers which means I have to replace them in orders to run the engine. When we removed the valve covers to install the new ones is when we found the bad cams. An actual mechanic would know this. I have contacted a parts store to look in a interchangeable parts manual and a 4.7 motor out of a 2003 dodge Dakota is only interchangeable with 2003 2004 and 2005 vehicles meaning the engine they sold me will not work. I am not satisfied and will handle this in court.
