Review: I purchased a car from dealer and at the time of purchase the dealer sold the car to me with a cracked windshild that was in my view of driving had got pulled over by police was told that was a illegal sale of car so I went back to dealer and explained what happend he offered to give my money back for the purchase of the car I never told him no went back the next day and told him I would take him up on his offer he explained to me that he couldnt because he had gone to auction and didnt have the money to give back to me I told him ok what about giveing me a different car that doesnt have a cracked winshild he said he couldnt do that so then he said what he could do is replace my windshild I told him ok by law he has to cause he knew it was a illegal sale when purchased. I later noticed that everytime I would fuel gas I could smell it and my gas hand wouldnt move had my car looked at then was told that there was a fuel leak from the car took the car back to the dealer and had told him that there was a fuel leak and it wasnt safe for me and my child said he would get someone to look at it and when they did they said they couldnt fix it.[redacted] failed to assist the problem. Then on may 12th at 12:30am I was driving and on the highway and the car stopped right on the freeway I did notify [redacted] and havent heard anything from him since that night. I Have in Writting by [redacted] that what ever was wrong with the car he was going to have replace and fixDesired Settlement: I would like my money back that was offered to me in the beginning I only had the car for a month and already there is a problem and the dealer is carrying out his word and knowing there is a problem and the lack of communication that he doesnt put effort to its like he is all about the money and not making sure the customers are happy

In response to the Complaint filed against Horne's Auto Sales from [redacted]:

On March 14, 2013 Horne's Auto Sales sold a 2003 Pontiac Grand Am to Miss [redacted]. The Vehicles Sale Price was $3990. The vehicle was Negotiated to the price of $3000 Dollars and Sold to Miss [redacted]. Miss [redacted] has a Balance of $331.75 which she agreed to pay one week after the purchase of the vehicle. When Horne's Auto Sales called her about this 2 day before the payment was due, she confirmed that she would be in Friday 3/22/2013 to Pay the balance of the Contract off. She did not pay. We notified her again the following week and asked her to pay the balance she had promised to pay. Her response was that she couldn't and that she would be in by the end of the week to pay. This Fridaycame and went as well. She had been driving the Vehicle for 2 weeks with no complaint?? When We called her the 3rd time to persuade her to pay the Balance she owed. She responded that she wanted her money back because We sold her the vehicle with a Cracked Windshield and that she could smell gas and that the vehicle was mysteriously leaking gas?? She brought a Man into our business that Threatened that if we did not give Miss [redacted] her money back that She would sue us. She was then told that we had a viable contract and that Horne's Auto Sales would not give her her money back, but would work with her and replace the Windshield and check into her so called gas leak to access the situation. We sent a mechanic up to her home to Find out what the problem was. His response to us after Scanning the system with a computer was that it threw an Evap code which commonly comes from the Gas cap not getting tightened and sealed appropriately after putting gas in the vehicle. In other words, the Customer did not tighten the gas cap after putting fuel into her vehicle- Which actually created this problem. The Code was cleared, and to my knowledge has not returned. Problem Solved. Horne's Auto Sales also put a new Windshield in the Vehicle. Approximately One week latter, we receive a phone call from Miss [redacted] expressing that she had another problem. Apparently the vehicle Stalled on her. She said she wanted us to tend to her immediately and fix the car. We told her that our mechanic was busy and that we would do our best to get her in as soon as possible. She insisted that we do it by the end of the day or that she would again sue us. We hung up the phone with Miss [redacted] and Immediately called our Mechanic. He was very kind to get her in that same afternoon. After his diagnosis, while Miss [redacted] was still there at his shop, he called us and told us he could not confirm what the issue was with the car and that he would need more time with it. In the time the Mechanic had the vehicle, he could not find a problem with the Car. The Mechanic set up a time the following morning @ 8 am with the customer to further Diagnose the problem and fix the Vehicle. At this time, We expressed to the Mechanic and the Customer that Horne's Auto Sales would not fix the vehicle until Miss [redacted] came into our office and Signed a "Good Will Service Faith Agreement" (A legal form that we must have the Customer fill out before we fix anything mechanical on their Vehicle. Miss [redacted] refused to do so, and did not accept our offer to in Good Faith fix the Vehicle, and did not follow through with the Appointment that she committed to. Miss [redacted] continues to drive the Vehicle. A few days latter the Owner of Horne's Auto Sales received a Nasty phone call at12:30 am in the morning on his cell phone waking him and his family up to complain about the car stalling again(The same problem that we were willing to fix a few days earlier) and that she wanted her money back. We again told Miss [redacted] that we would not give her here money back and that we did not appreciate the Phone call at that time of the morning. Both Mechanics expressed to me that the Car is a good sound car. Occasionally used cars can malfunction. This is why typically Used cars are sold AS-IS. Horne's Auto Sales was not obligated to help Miss [redacted]. She signed an AS IS Agreement. But because we want a good relationship with all of our Customers, We are willing to help the customer out. Contrary to Miss [redacted]'s thinking, this is what we tried to do all along. We are an Accredited Business with the Revdex.com and work hard to try to have a Good reputation in the Auto Industry. Miss [redacted] Still has not satisfied her Debt, and continues to drive the Vehicle. Although Horne's Auto Sales has the right to Re posses the Vehicle from Miss [redacted], We have chose not to at this time.

I have reviewed the response made by the business in reference to complaint ID 9542269, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.

I do not accept what was written out because MR.[redacted] failed to keep his promise of what was told to me during the purchase of the car that me and my witness heard him say Mr. [redacted] is a fruad and he tried to get over on me and when I mentioned it to him the next day I went back and I asked him why is there a remaining balace of 331 and he told me that was for me to get my title to the car and the doc fee of him filling out the paperwork I explained to him why didnt he tell me this before I said that is crazy just to get a title and the sales tax should have been included because I gave him 3180 for the car and I told him the 180 left over should have been applied to the doc fee but yet he claims there was only 3000 but he claim there wasnt and me and my witness and him counted the money in his office. I went back to him one week later and told him that there was something wrong with the car I smelt gas and I took my car over a personal mechanic and they explained to me what was going on when he had one of his come to my house yet again I had my witness and his mechanic said that there was to much to be done and he couldnt do it my mother also spoke to the first mechanic to. when I went to the second mechanic he claimed that there wasnt anything wrong with it and all he did was drive the car for five minutes came back and said oh I dont see nothing wrong he didnt look at it or anything. then two weeks later the car broke down on the side of the highway at 1230 at night with my child in the back seat as far as my thoughts about [redacted]s auto [redacted] failed to try to resolve the matter and when I told him that the car broke down and he told me that he wasnt doing anything to fix the problem that is why he does not have good bussiness with me. I spoke to my lawyer about the paper work that he was talking about and he told me that I didnt need to sign no paperwork just for my car to be fixed by a mechanic and advised me not to sign no paperwork because he should have had me sign the paper the day of the purchase of car.
