Good afternoon.First of all we had a contract with *** *** so *** *** cant even make this complaint against my company! to do his back yard and yes sprinkler was included.** *** delay the continuation and completion of work as he had entire a substance abuse program and
was away for a period of time where he could not be reached or spoken to even though we tried.His wife contacted us trying to have contract deposit returned to her but we could not do that without speaking to ** *** first which she was not happy about.That said when ** *** finally was released from his rehab and contacted us about continuing work we discussed his options.He had signed a contract for work on front of house in amount of $30,and we had a one third deposit.He stated that he had no more money and asked what we could do with the funds he had already given usWe explained obviously we could not complete$30,dollars worth of work for $10,but we could do part of the project .We spoke about completing brick paver walkway and driveway borders and apron with asphalt in center of driveway.** *** then said is there any way we can do entire driveway in paving stone and we could forgo and other work due to him in front (SPRINKLER) using the funds to help toward an entire driveway done with paving stone.This is how the project was completed .Technically ** *** was in breach of contract by not following through but we understood his problems wished him well and finished our work as discussed.From the to when *** *** contacted us I have not seen or heard from ** ***.I dont know if he is around or not and he can contact me to resolve this ant any time if he would like.I tried to explain this to *** *** and offered to do the work she was requesting at our cost of material and labor ,she tried to haggle over the price and I guess her complaint is the outcome of me not being willing to do work and loose money doing it .Again I am willing to discuss this at any time with ** *** he is who I have contracted with.Best Regards Adam M*** pres.Topaz Design Group INC

Adam did not speak to my husband or discuss using money from the sprinklers for the front of the houseYes, my husband was in rehab and so Adam was speaking to me from that point onI did not want to cancel the job with Adam, I just asked to change what could be done to they money he had as a deposit for the projectHe decided to put the project on hold until he verified that the situation with my husband about being in rehab and loosing his job was trueIt took many attempts to get in touch with Adam and he was very nasty towards me and obviously did not want to deal with meI could not understand why since we paid him about 87k for the backyard project that's including the sprinklersWhen I finally spoke to him about the front yard the following season, he laid out the options which no longer included redoing the sidewalk, plants, landscaping, or extending and redoing the whole front porch, which was expectedHe said all he could do was the pavers in the front, including the drivewaySo that's what I gave him the go ahead forI also reminded him about the sprinklers and he said he'd send his guy to come look at was needs to be finished after everything was done with the paversI noticed he didn't pour any cement like he did for the backyard pavers so I asked his lead worker about it and gave Adam a call for clarification, which he dd not answerI was told by the lead worker the pavers should be fine even in the driveway but if I want extra support I could have cement poured in the driveway sectionHe spoke with Adam and Adam told him, not me, that it would be an extra $for the cement and to get the money upfrontI wrote a check and that was the last? head from Adam through any meansThe sprinkler guy came, checked out the installment and told my husband that he needed to speak with Adam and then he'll return to finish when Adam schedules himWhen I didn't hear back from him or Adam I called and was told it was too late in the season and that he'll have the sprinkler guy come next springI didn't think that was a big deal since we didn't have any plants out front and up until then Adam completed what he said he wouldCome this spring, I called Adam and he said he never spoke with the sprinkler guy and was not aware of anything, to please call his office and leave a message with the front desk so that they can schedule us so the sprinklers get finishedI did just that, spoke with a Maria I? believeAfter about 2-weeks I called again, no one answered, I left voicemailsAll in all I called about times in a matter of weeksOne day I had a missed call from Adam so I returned the call to the office and Adam answered surprisinglyHe immediately did not let me speak, was very nasty and told me he would not complete the sprinklers unless we paid him an additional $just for cost of materials because after running the numbers, he'll be loosing money on this project because he did us a favor by doing what he did out front, and went on and onI tried asking what favor? Since it's not like he didn't get paidBut he would not let me speak and just told me to call him back if I wanted to proceed with that paymentThis conversation also included trees he was supposed to replace but I'm not asking for that, I'm asking for the sprinklersAfter this phone conversation I decided to email him with my thoughts and what was brewing inside of me and also for proof of our conversationSo attached is that email conversation where he talks about doing us a favor, NOT talking to my husband and letting us know he would be allocating the sprinkler money for the front paversBecause that did not happenMost of his conversations if not all were with me and he barely spoke to me and when he did he was nasty and condescending
