HORST & SON

The quality of Horst builders homes are not of quality work. They use subcontractors that perform below standards. Walls are not square, floors lean, problems with plumbing, painting and it takes forever for the work to be performed. I would not recommend this builder.

Review: The house in question was built in 2009 and sold to first owner on Jan 15, 2010. We purchased the house from the first owner in June 2011. According to the information in the [redacted] Public Offiring Statement there is to be a warranty of two years from the date of settlement and no action to enforce the warranty shall be commenced later than six years after the warranty begins.

The problems are that there is not sufficient clearance between the bottom of the walk in garage door and the door threshhold. I replaced the ruined seal in the fall (Sep 2012) and within one month the new seal had destroyed itself because it was rubbing too hard on the threshhold. I called Horst & Son and talked to [redacted] Horst. [redacted] came and looked at the problem but did not offer to fix it and suggested an idea that might fix the problem. The suggested fix did not work and I call [redacted] back and his answer was that it was too cold then and he would look at it later.

When spring came and he had not returned to fix the problem I called Horst & Son, Inc and left a message to call me which [redacted] never did. I tried to contact [redacted] 3 or 4 more times and he never returned the call. The last time that I talked to [redacted] in late 2012 I also told him about the poor window seals and dry wall fasteners that had popped loose and got no response. The window seals leak so much air that on a windy day the air entering the room from outside will blow out a butane lilghter when held near the leak.Desired Settlement: --Repair the garage walk in door so a seal can be installed and not destroy itself.

--Repair the window seals to stop the air leaks and if not possible then replace the windows.

--Repair the wall where the dry wall fasteners have failed and repaint or repair the wall from any damage done during the fasterner replacement.

Attention: [redacted] I apologize for not having answered your email sooner but my computer was not working and in the shop for repairs until recently. I don't have a copy of the firms warranty since I was the second owner. However, I am sending, as an attachment, two pages from the [redacted] Homeowners Association book which lists the terms of the warranty. Also since I am the second owner I don't have a signed contract with the firm that built the house. Sorry for the delay. Regards, [redacted]

This is in response to the attached letter we received dated November 19, 2013. According to our records, an agreement of sale was signed with the original homeowner for [redacted] on December 24, 2008 and subsequently settled on March 31, 2009. Our agreement included a one year limited warranty, which was signed by the original purchaser, which I attached. The warranty notes that the warranty is for one year and is non-transferrable. In addition, the items mentioned in the complaint are maintenance items not covered under the warranty.
