I am a partner of Horwitz & Zim Law Group, P.CRecently, my firm received a copy of the above referenced complaint dated July *, This letter shall serve as my response to clear up the above complaint.First, the complainant, [redacted] , is not and never has been a customer/client of this firm and there is no consumer transaction involved between the parties! Instead, [redacted] is a tenant of Apartment [redacted] at [redacted] for which my client, [redacted] Street Realty Corpis the owner and landlord [redacted] ’s tenancy began on June **, and ended on June **, A copy of the lease agreements for the period from June **, 2009-June **, 2011, June **, 2011-June **, 2013, and June **, 2013-June **, are attached as Exhibit A.Despite [redacted] ’s contentions to the contrary, I contacted her via the e-mail and mail address that she provided to my client, yet, she denies being the same personIn my letter to [redacted] dated June **, 2015, a copy of which is attached as Exhibit B, I simply advised her that she was in default of her lease obligations as she has not paid rent for May and June in the sum of $2,per month for a total of $5,Additionally, [redacted] ’s lease ended on June **, 2015, however, she did not move-out and had not surrendered legal possession of the apartment to the Landlord as of July *, Accordingly, I advised [redacted] by mail that she owes rent and/or use and occupancy for the months of May 2015, June and July at the rate of $2,per month for a total of $8,250.00, but that the Landlord would agree to waive the rent if she moved-outA copy of my July, letter is annexed as Exhibit C.Lastly, on July **, my office received an undated letter from [redacted] acknowledging that she is “packing & moving out process right away & make the Aptavailable for the Landlord in August ” A copy of the July, letter is annexed hereto as Exhibit D.I trust that this letter clarifies the above referenced matterHowever, if you require further information or have any questions, please contact me at ###-###-####

Review: Eric M. Z[redacted] Esq. from Horwitz & Zim Law Group, P.C. ([redacted]) sent me an e-mail followed by mail sent to third party address stating that I am in default of lease obligations. However, I am not associated with the property which he listed in the letter in any regards. I called Mr.Z** right away to explain myself and said that it was a mix up. He refused to provide any comments. As my first and last name was used in the letter I became concerned about identity theft. I made multiple attempts (e-mails, phone calls) to contact Mr. Z** to "clear the air", but he remained in complete denial.While I am still in the process of making sure that my personal information was not compromised, I have never been reached by the law firm with the explanations why they sent me such letter.Desired Settlement: Statement from the law firm that my personal information was not compromised in this particular matter and their claims are irrelevant to me.
