As a hotel our goal is to deliver great customer experienceIt is unfortunate that our customer's experience was not the outcome that we hoped forMore sadly because it was due to something that the hotel could not controlThe facts of the matter are as presented in the complaint to the extent that the guest stayed with us and reported loss of personal items the following morningWhen I had the chance to talk to the customer, the Director of Sales had repeatedly told the customer that by law, the hotel assumes no liability for theft of a vehicle or items left in vehicle and/or damage to vehicles parked on premisesThere are signs posted around the entire parking lot as required by lawParking on premises is "at your own risk" provisionA claim was filed with the hotel insurance company following the guest's refusal to accept the explanation from hotel managementThe customer was informed that the hotel management has no influence in the manner the insurance company decides to resolve the matterHotels are generally not liable for harm to guests caused by criminal acts of others, unless hotel fault is establishedPotential Liability of the hotel (innkeepers for loss or damage to a guest's property) is limited by statuteI strongly object to the guest's allegations of negligenceNegligence suggests that the innkeeper failed to prevent harm that was caused by a foreseeable riskThis is a random crime that took place on our propertyThe fact that this happened at our hotel does not imply 'fault on our part"Having addressed the issue of the motor cycle and the parking lot in regards to hotel liability status, I could also add that the items that were left on the motorcycle are considered unsecuredIn fact the signs we have posted encourages all our guests to remove all valuable items from their vehicles for the aforementioned reasonThe hotel does have security, yes, but the fact that he had to perform tasks does not imply negligenceWhile we strive to provide reasonable protection to our guests, having security patrol the property is not in any way a guarantee that unforeseen risks will not occurAs a result, losses of this nature are generally reported to the automobile insurance or any other insurance the customer might have, in the event our insurance fails to resolve the matter to the guest's satisfaction
