I am corporate counsel for Little Frog, Bistro & Bar and submit this response to the customer complaint (ID # ***) on behalf of the restaurant The complainant is mistaken regarding a law requiring that this gift certificate (which was donated for charitable purposes) be
extended for years The law the complainant is referring to is General Business Law Section 396-i which applies more generally to the type of gift cards commonly purchased directly from stores/merchants for consideration The law, however, simply does not applies to cards or certificates from a restaurant "donated" to a charity for no consideration and for charitable purposes [Please see New York General Business Law Section subsections 3-b.] The year time limit which the complainant refers to is expressly not applicable to gift certificates given to "non-profit and charitable organizations or educations institutions for fundraising purposes" This merchant often donates such certificates for charitable purposes (which the cited law encourages) and this was explained to the complainant It is a common practice with any such gift certificate donated to charity that it have an expiration date displayed on the certificate. In this case, the complainant admits to receiving his certificate in February and the certificate clearly shows an expiration date of June **, Despite the complainant admitting to having months (Feb/March/April/May/June) to use the certificate, he did not chose to attempt its use until November 2017, a full months "after" it expired Clearly, in this case, the complainant chose to simply ignore the expiration date Despite this, the owner of the restaurant did attempt to work out a solution in good faith for the complainant by offering a free bottle of wine should he choose to dine Instead, the complainant posted a negative review on a social media website regarding this issue, and then filed this complaint
