I have reviewed the response offer made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below First of all, Magic City Ford DID NOT return our initial call and they DID NOT offer to remove the window film until after I had the tinting removed and after I placed a follow up call to them I had the tinting removed immediately because courts look favorably when corrective action is taken right away I had the tinting removed by a window tinting business - they apply and remove window tinting every dayThis company is much better equipped and experienced to remove the tint while preventing damage to the car (rear window defroster, chemical damage to interior, etc).Additionally, I was told at the window tinting place that darkness of the window tinting is not a part of the state vehicle inspection However, they also told me that my vehicle should not have passed the state inspection since the tinting was applied over the third brake light in the rear window It is against the law to place anything over this third brake light and when the vehicle was inspected at Magic City, this should have been picked up and corrected.When I went to court, the judge did dismiss the charge since I took the ticket seriously and had the window tinting removed immediately However, even though the charges were dropped, I still had to pay court costs.The window tinting issue has been around for many years When I first saw this car on the lot, I noticed the dark windows right away But I assumed that the tinting was a part of the factory installed items on the "LIMITED" "LTX" model or the "RALLY SPORT" package that was on the car And since it had been inspected just that month by Magic City Ford, I again assumed that everything was legal I did not inspect the edges of the windows for aftermarket window tinting film until after the trooper pulled me over As soon as I saw the film, I knew that the glass itself was not dark but that aftermarket tinting had been applied.And this should never have happened at an established dealership like Magic City With their experience, they should be aware of dark window tinting in their used cars and not put them up for sale until they are corrected And then, after a problem like this comes up, they should be more responsive to a customer that just spent a great deal of money at their business and has assumed that the car they just purchased is legal to operate on the highways of Virginia.I would like to be reimbursed for the money that I have had to pay to resolve this issue I would also hope that Magic City Ford would look more closely at window tinting of the used cars that they take in and not sell them without correcting them or warning any prospective buyers Regards, [redacted] ***

I thank you for your response, however I must stand by my original response The car is an "as is" vehicle and the customer signed every form that stated they understood that I cannot make an exception for one customer, it wouldn't be fair to the other customers that have purchased "as is" vehicles I also went back to my sales person to verify the statement in the response It was explained to me that the sales person stated to the customer, lets try another cd because maybe the first cd had something wrong with it (like being warped) The sales person is very clear on selling "as is" vehiclesWe have the customer sign so many different documents stating they understand what they are purchasing We are sorry the customer is frustrated and we are still willing to allow them to purchase the new cd player at the original offer Thank you, [redacted] ***

Please have Mr [redacted] submit his receipts to me I am sorry that he wasn't called back promptly Thank you, ***

I have spoken to Ms*** on several occasions about her complaint. She also contacted the Attorney Generals office and the case was closed with them on October 28, 2016. I have attached a copy of the warranty that she signed stating remainder of factory warranty left on the
vehicle. I am not at liberty to discuss her credit score with anyone. The claim she is making is false. Magic City protocol is that we take a credit statement at the time a customer wishes to purchase a vehicle, it is then submitted to several banks for approval to find the best interest rate. A credit score can be affected by many different items and the one that lease affects the credit score are inquiries. I understand she is not happy and I have explained to the Attorney Generals office and Ms*** that we would never tell someone a car would come with a new 3/warranty. I am truly sorry, I just can't resolve her issue. Thank you, *** ***

I have reviewed *** issue *** was a salesperson at Magic City at the time she made her purchase She herself along with a sales manager located the car from the ** dealerAs a salesperson, she would have known exactly where the car came from At the time the car
arrived at Magic City she inspected the car and accepted it with the aftermarket window tint (All customers inspect their cars upon arrival before taking ownership).As a sales person she is most aware that the window tint was not put on at the factory As an aftermarket product the window tint is not covered under any kind of manufacture warranty I also called the ** dealer and *** did not tell them that she was a salesperson at Magic City at the time of purchase and that she made them believe that Magic City was misleading her I ask for the name of the company that put the window tint on, however due to the fact that *** had contacted them, they would not release any information to me. I would ask that due to the fact that *** is a former employee of Magic City, she contact me directly We will be happy to help try and resolve her issue. Thanks,

I have attached the files from this complaint. As you look at the documents you will see the customer purchased an "as is" vehicle. There are different documents signed stating it was an "as is" vehicle. The we owe form shows we would address the issue of the cd being in the cd
player. It does not state that we would repair it. When a vehicle is sold as is, we are telling the customer we don't know the condition of the vehicle. That is the reason for all the signatures stating its "as is". We had the cd removed from the cd player as promised. I cannot make an exception to repair this cd player as it would not be fair to all the other customers who have purchased "as is" vehicles
We can offer to sell them a new radio/cd for the car at our wholesale price

As stated in the complain, during the test drive we noticed the problem, after we try to play musicThe salesperson, *** (who was with us during the test drive) verbally told us that the cd issue will be fixed, not just remove the CDIn fact, when we went to pick up the car during the initial fix, *** decided to try the CD to see if it works, and it got stuck againAt that point, she verbally told us to set another appointment for the CD to be fixed. We called the following week to set an appointment only to received no response. We left a couple of voicemail messages, but to no availSo we decided to drive to her*** did not give us a copy of the document that states that the CD will be removed only, during the transaction or during the time we went to get the car, instead gave us verbal promise that she will have her people fix itSo if *** did not promise to have her mechanic fixed the CD, why did she try testing it after we when to pick up the vehicle? We were going to walk away after noticing a couple of issues on the car during he test drive, but ***, not willing to let us leave without purchasing the car, verbally gave us the assurance that she will address all issues we observed during the test driveWhat in the world would we worry about removing just a CD that cost only $or less, instead of the CD player? So we are not accepting the offer and would take a legal action if CD is not fixedWe have both verbal and written agreement with the salesperson and we are standing by it

We had a written and verbal contract with the salesperson, We heard this statement from you over and over [so as is]. A vehicle is not sold as is when the problem was found why the vehicle was still on your property or in your possession and made a verbal agreement to get it fix but refused. That is not a defense to sold as is, That's fraud.

I have researched this complaint with my team and was informed that Mr. [redacted] in fact did speak with his sales person and we offered to have him bring the vehicle back to Magic City and we would remove the window tint for him.  I understand his frustration on being pulled over and receiving a...

citation.  After further investigation, window tint is not a state inspection item as far as darkness goes.  The VA State Police inspection manual states that if the window tint is scratched, distorted or wrinkled that would cause the vehicle to fail inspection.   Mr. [redacted] is welcome to stop by and I can show him the manual.  Normally, at the court hearing the judge will dismiss the citation as long as a letter is present that the tint has been removed.  I would be happy to remove his tint and have the letter written.  I am very sorry this happened to Mr. [redacted] and will happily remove his tint. Thanks, [redacted]
