My Name is*** ***, owner and operator of Houck Rentals LLC, a rental and new construction businessI fully appreciate and admire the effort of the home owner to desire a completed construction siteUnfortunately, construction is not as easy and simple as one might imagineThere are several steps necessary to complete in order to have a desirable and satisfactory outcomeI will list the following reasons why we are at the stage we are currently: Kentucky Erosion Prevention and Sediment Control Rules and RegulationsThe entrance (egress and ingress) was bonded to the city for proper installationThe sidewalks were also bonded on a per foot basis for *** *** DevelopmentAny blue line stream cannot be altered per EPA Regulations(Rear Creek) There are CMP that drain in front of site locationand only CMP that exits---- Development mistake that has to be fixed by the engineering department of the city of BardstownThe front ditch does not even belong to the home ownerand this is one of their complaintsIgnorance on the homeowner should not be a reflection on me or my business7.The rear stream is located with in an easement that belongs to the city of BardstownI paid over $14,to have this water way engineered and constructed for the benefit of the residents in this areaIt can not and will not be alter without the prior written consent of the City of Bardstown, Frankfort, and the EPA Division of WaterJust because you own something does not give you the right to do whatever you wishWe have laws, rules, and regulations that protect the city, county, and surrounding areasFinal grading was delayed from the winter when grass would not obviously grow till the spring when it wouldThis is nothing more than plain common senseI graded and seeded the yard just like agreed in the springSince then the owner has had a good stand of grassThe drains I installed were put in properly weeks after grading and seeding just like plannedAll looks good and working efficientlyI have just completed another meeting at the city of Bardstown discussing our methods of final grading of the front ditchthat belongs to the citynot the home ownerI will be glad to discuss the rear concrete patio concerns with home ownerThe desired outcome that the home owner wantsI am confident that if a little common sense and patience is utilized we can accomplish these concernsI look forward to working with the home owners to resolve this matter as quickly and efficiently as possibleThank you for your cooperation and keeping an open mind! I have reviewed the response made by the business in reference to complaint ID***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
[Please note that in my complaint I referenced the business owner's missed verbal commitment to June 25th for onsite work on the front and rear ditches, and also his lack of communication concerning this work Had MrHouck courteously discussed all the details he discloses in his response, I would have been made aware of those various situations and requirements, and willing to work with him in whatever way was reasonable and appropriate for a property closure that occurred Jan 10th, But his response only comes after action has been taken I still require completion, at business owner's expense and to city specifications, of the front and rear drain ways, as well as repair of the rear patio to close this complaint Though the drain ways and easements are under city regulation, per discussion with city civil engineers, they are still the responsibility, initially, of the builder, and need to be completed such that the home owner can easily maintain them Finally, since I am a two-time client of this business with my financial obligations paid in full, it is reasonable to expect MrHouck's future responses to be professional and to the point rather than personal, i.eusing terms such as "open mixed", "patient", and "common sense".]
